The initiative comes ahead of modernised European insolvency laws (IP/12/1354) that would make it obligatory (48 months after adoption) for Member States to publish key information on insolvency proceedings in electronic insolvency registers.
Cette initiative s’inscrit dans le cadre de la modernisation annoncée de la législation de l’UE en matière d’insolvabilité (voir IP/12/1354), qui prévoit d’imposer aux États membres (48 mois après adoption de la législation révisée) l’obligation de publier les informations essentielles sur les procédures d’insolvabilité dans des registres d’insolvabilité électroniques.

I believe that action by Europe outside the ambit of obligatory European laws, which cannot be introduced in this area, can be offered in the context of the struggle against discrimination.

This term excludes contractual provisions other than those which serve to implement an insurance obligation arising from the laws and regulations referred to in the preceding subparagraph or which have been the subject of a decision by the public authorities which makes them obligatory or extends their scope, provided that the Member State concerned makes a declaration to that effect, notified to the President of the European Parliament and the President of the Council of the European Union.
