The Commission shall inform the European Parliament and the Council without delay of the notification received by the Member States concerned and examine the notification taking into account the number of Member States affected by any of the situations described in paragraph 1 and the overall impact of the increases on the migratory situation in the Union as the latter appears from the data provided by the Member States as well as from reports prepared by FRONTEX and/or the European Asylum Support Office and, within three months following receipt thereof, the Commission shall send the results of its examination to the European Parliament and the Council, which shall give their opinion in a timely manner, after which the Commission may adopt an implementing decision suspending the exemption of visa requirement for the nationals of the third country concerned for a period of six months. In order to ensure that market abuse is prevented, Member States should take into account, for the purpose of implementation of this Directive, the provisions of Directive 2003/6/EC of the European Parliament and of the Council of 28 January 2003 on insider dealing and market manipulation (market abuse) (7), Commission Regulation (EC) No 2273/2003 of 22 December 2003 implementing Directive 2003/6/EC of the European Parliament and of the Council as regards exemptions for buy-back programmes and stabilisation of financial instruments (8) and Commission Directive 2004/72/EC of 29 April 2004 implementing Directive 2003/6/EC of the European Parliament and of the Council as regards accepted market practices, the definition of inside information in relation to derivatives on commodities, the drawing up of lists of insiders, the notification of managers' transactions and the notification of suspicious transactions (9).

Calls on the Commission to consider the advisability of extending the scope of the exemption of notification without thresholds to other SSGI sectors, in the light of the considerations that led to the current exemption of notification for hospital and social housing sectors and taking into account the fact that, at this stage of the development of the internal market, the intensity of the distortion of competition in these sectors is not necessarily proportional to revenues and the amount of compensation; calls on the Commission to exempt from the notification requirement subsidies granted under the terms of contracts concluded as a result of competitive tendering; taking into account the fact that existing alternatives to competitive tendering (in house, authorisation schemes, mandating, etc.) can be more readily tailored to the specific characteristics of SSGI;
