Definition: This block contains a wide variety of disorders that differ in severity and clinical form but that are all attributable to the use of one or more psychoactive substances, which may or may not have been medically prescribed. The Commission shall inform the European Parliament and the Council without delay of the notification received by the Member States concerned and examine the notification taking into account the number of Member States affected by any of the situations described in paragraph 1 and the overall impact of the increases on the migratory situation in the Union as the latter appears from the data provided by the Member States as well as from reports prepared by FRONTEX and/or the European Asylum Support Office and, within three months following receipt thereof, the Commission shall send the results of its examination to the European Parliament and the Council, which shall give their opinion in a timely manner, after which the Commission may adopt an implementing decision suspending the exemption of visa requirement for the nationals of the third country concerned for a period of six months. The implementing decision shall be adopted in accordance with the procedure referred to in Article 4a (2).

In order to improve the reliability of such lists, appropriate verification and/or correction mechanisms and minimum guarantees for the persons concerned should be established, at least at the initiative of the Member States of the Sanctions Committees which are also members of the EU. It is also worth drawing attention to the fact that the latter countries have an obligation to cooperate sincerely with the EU and the other Member States, as provided for in Article 19 of the TEU, which stipulates that "Member States which are also members of the United Nations Security Council will concert and keep the other Member States fully informed”. This requirement is all the more necessary in such situations since the list, once adopted, will make the EU institutions and the Member States accountable before the Strasbourg and Luxembourg Courts.

Community provisions relating thereto have been established by Council Regulation (EC) No 515/97 of 13 March 1997 on mutual assistance between the administrative authorities of the Member States and co-operation between the latter and the Commission to ensure the correct application of the law on customs and agricultural matters and by Council Directive 89/608/EEC of 21 November 1989 on mutual assistance between the administrative authorities of the Member States and co-operation between the latter and the Commission to ensure the correct application of legislation on veterinary and zootechnical matters.
