It claimed that the German Banking Supervisory Authority (Bundesaufsichtsamt für das Kreditwesen - BAKred) had infringed Article 4(1) of Council Directive 89/299/EEC of 17 April 1989 on the own funds of credit institutions (Own Funds Directive)(2), as last amended by the Documents concerning the accession of Austria, Finland and Sweden, when accepting assets of the Wohnungsbauförderungsanstalt des Landes Nordrhein-Westfalen (Wfa), which had been merged with Westdeutsche Landesbank Girozentrale (WestLB), as own funds of the latter.

From that information the Commission established the need to review certain measures in depth, namely: - a waiver in 1984 of outstanding claims of 47 mio DM by the Westdeutsche Landesbank Girozentrale (WestLB); - a guarantee granted by the Land of Nordrhein-Westfalen in 1993 in relation to a 20 mio DM credit given to Gildemeister in 1992; - in 1994, the financing by the Bavarian authorities, through the "Bayernfonds" programme, of 1% of the 9.25% interest rate of a 15 mio DM credit given by the Bayerische Landesanstallt für Aufbaufinanzierung (LfA) in the framework of Gildemeister's takeover of Deckel/Maho; - a subordinate guarantee for 10 mio DM given by the LfA and the Thüringische Industrie-Beteiligungsgesellschaft (TIB) in favour of the WestLB for its guarantee for the placing on the market of Gildemeister's capital increase of 34 mio DM in October 1994.
