Definition: Voluntary, repetitive, stereotyped, nonfunctional (and often rhythmic) movements that do not form part of any recognized psychiatric or neurological condition. When such movements occur as symptoms of some other disorder, only the overall disorder should be recorded. The movements that are of a non self-injurious variety include: body-rocking, head-rocking, hair-plucking, hair-twisting, finger-flicking mannerisms, and hand-flapping. Stereotyped self-injurious behaviour includes repetitive head-banging, face-slapping, eye-poking, and biting of hands, lips or other body parts. All the stereotyped movement disorders occur most frequently in association with mental retardation (when this is the case, both should be recorded). If eye-poking occurs in a child with visual impairment, both should be coded: eye-poking under this category and the visual condition under the appropriate somatic disorder code. | Stereotype/habit disorder

In order to ensure uniform conditions for the implementation of this Regulation, implementing powers should be conferred on the Commission with respect to the list of Member States or parts thereof that have equivalent favourable status with regard to rabies and that are authorised to conclude mutual agreements to derogate from certain conditions applicable to the non-commercial movement of pet animals, the list of Member States categorised in accordance with the rules concerning preventive health measures against diseases and infections other than rabies, the lists of territories and third countries established for the purpose of derogating from certain conditions applicable to non-commercial movement, the model for the identification documents that are to accompany pet animals of the species listed in Annex I during non-commercial movement into a Member State from another Member State or from a territory or a third country, the rules on the format, layout and languages of the declarations to be signed, and the safeguard measures in the event of the occurrence or spread of rabies or of a disease or infection other than rabies.

5. In order to prevent commercial movement of pet animals of the species listed in Part B of Annex I from being fraudulently disguised as non-commercial movement, the Commission shall be empowered to adopt delegated acts in accordance with Article 39 laying down rules setting the maximum number of pet animals of those species that may accompany the owner or an authorised person during a single non-commercial movement.
5. Afin d’éviter que des mouvements commerciaux d’animaux de compagnie des espèces répertoriées à l’annexe I, partie B, ne soient frauduleusement camouflés en mouvements non commerciaux, la Commission est habilitée à adopter des actes délégués en conformité avec l’article 39 établissant des règles limitant le nombre d’animaux de compagnie de ces espèces qui peuvent accompagner le propriétaire ou une personne autorisée au cours d’un seul et même mouvement non commercial.

Commission Implementing Decision 2011/874/EU of 15 December 2011 laying down the list of third countries and territories authorised for imports of dogs, cats and ferrets and for non-commercial movements of more than five dogs, cats and ferrets into the Union and the model certificates for imports and non-commercial movement of those animals into the Union establishes the model health certificate attesting compliance with the requirements of Regulation (EC) No 998/2003 for the non-commercial movement of five or fewer dogs, cats or ferrets into the Union.

However, in the interest of consistency of Union law, pending the establishment of Union rules governing the non-commercial movement into a Member State from another Member State or from a territory or a third country of pet animals of the species listed in Part B of Annex I, it should be possible for national rules to apply to such movement provided that they are not stricter than those applied to movement for commercial purposes.

In order to avoid commercial movements fraudulently disguised as non-commercial movements of pet animals, the Commission shall be empowered to adopt delegated acts in accordance with Article 41 to lay down rules limiting the number of pet animals of the species listed in Annex I that may accompany the owner or a natural person acting on behalf of and in agreement with the owner for a single non-commercial movement.
2. Therefore, the rapporteur has sought to improve the readability and clarity of the Commission's proposal in order to allow for a clear, unambiguous application by pet owners, veterinarians, enforcement staff, competent authorities and other actors involved in the non-commercial movement of pets. As a result, the wording and occasionally the order of certain articles have been changed while often keeping to the main message of a respective provision.

(12) In order to make a clear distinction between the rules that apply to movements for non-commercial purposes and to trade in and imports into the Union from third countries of dogs, cats and ferrets covered by the animal health requirements of Directive 92/65/EEC, this Regulation should not only define a pet animal but also the non-commercial movement of such animals as a movement which does not, either directly or indirectly, involve or aim at a financial gain or a transfer of ownership.
(12) Afin de distinguer clairement les règles applicables aux mouvements non commerciaux de celles applicables aux échanges et à l’importation dans l’Union de chiens, de chats et de furets en provenance de pays tiers, lesquels sont soumis aux conditions de police sanitaire de la directive 92/65/CEE, il y a lieu que le présent règlement définisse ce que l’on entend par animal de compagnie, tout en précisant que les mouvements non commerciaux de ces animaux désignent des mouvements qui n’entraînent ni ne visent, directement ou indirectement, un gain financier ou un transfert de propriété.

(34) In order to ensure uniform conditions for the implementation of this Regulation with respect to the list of Member States or parts thereof categorised in accordance with the conditions for derogating from certain conditions applicable to the non-commercial movement between Member States of equivalent status with regard to rabies of pet animals of the species listed in Part A of Annex I and with the rules concerning preventive health measures against diseases and infections other than rabies and the lists of third countries or territories for the purpose of derogating from certain non-commercial movement conditions, the model for the identification documents that are to accompany pet animals of the species listed in Annex I being moved for non-commercial purposes into a Member State from another Member State or from a third country or territory, safeguard measures in the event of the occurrence or spread of rabies, and the uniform application of information requirements, implementing powers should be conferred on the Commission.
(34) Il convient que la Commission se voie conférer des pouvoirs d’exécution afin de garantir des conditions uniformes d’application du présent règlement en ce qui concerne: la liste des États membres ou parties d’États membres classés conformément aux règles de dérogation à certaines conditions applicables aux mouvements non commerciaux d’animaux de compagnie des espèces répertoriées à l’annexe I, partie A, entre des États membres dont le statut au regard de la rage est équivalent, et conformément aux règles relatives aux mesures sanitaires de prévention de maladies ou d’infections autres que la rage; les listes de territoires ou de pays tiers aux fins de la dérogation à certaines conditions applicables aux mouvements non commerciaux; le modèle de document d’identification destiné à accompagner les animaux de compagnie des espèces répertoriées à l’annexe I introduits à des fins non commerciales dans un État membre depuis un autre État membre ou depuis un territoire ou un pays tiers; les mesures de sauvegarde en cas d’apparition ou de propagation de la rage; l’application uniforme des obligations d’information.

(12) In order to make a clear distinction between the rules that apply to movements for non-commercial purposes and to trade in and imports into the Union from third countries of dogs, cats and ferrets covered by the animal health requirements of Directive 92/65/EEC, this Regulation should not only define a pet animal but also the non-commercial movement of such an animal as a movement in which such a pet animal accompanies its owner or an authorised person.
