Acknowledges that the mission charter of the IAS was adopted by the Governing Board on 31 March 2011; notes that the Joint Undertaking's financial rules have not yet been amended to include the provisions of the framework Financial Regulation referring to the powers of the Commission's internal auditor due to the pending adoption of Regulation (EU) No 110/2014 on the model financial regulation for public-private partnership bodies referred to in Article 209 of Regulation (EU, Euratom) No 966/2012 of the European Parliament and of the Council which entered into force only on 8 February 2014;

In line with the new obligation introduced in Article 209(2) of Regulation (EU, Euratom) No 966/2012, which requires that an independent external auditor verify the annual accounts of the PPP body, the provisions in Delegated Regulation (EU) No 110/2014 should be aligned with the corresponding provisions in Delegated Regulation (EU) No 1271/2013.
Conformément à la nouvelle obligation instaurée à l'article 209, paragraphe 2, du règlement (UE, Euratom) no 966/2012, qui exige qu'un auditeur externe indépendant vérifie les comptes annuels de l'organisme de PPP, il convient d'harmoniser les dispositions figurant dans le règlement délégué (UE) no 110/2014 et les dispositions correspondantes prévues par le règlement délégué (UE) no 1271/2013.

Since the discharge for the implementation of the budget of each PPP body is to be given by the European Parliament, upon recommendation of the Council, to the director of the PPP body, the provisions of Commission Delegated Regulation (EU) No 110/2014 (4) which relate to the reporting obligations of the PPP bodies and to the discharge procedure should be made consistent with the corresponding provisions of Commission Delegated Regulation (EU) No 1271/2013 (5).
La décharge en vue de l'exécution du budget de chaque organisme de PPP devant être donnée par le Parlement européen, sur recommandation du Conseil, au directeur de l'organisme de PPP, il convient que les dispositions du règlement délégué (UE) no 110/2014 de la Commission (4) qui concernent les obligations en matière de rapports applicables aux organismes de PPP et la procédure de décharge, d'une part, et les dispositions correspondantes du règlement délégué (UE) no 1271/2013 de la Commission (5), d'autre part, soient harmonisées.

Without prejudice to Article 12 of this Regulation, the IMI2 Joint Undertaking shall adopt its specific financial rules in accordance with Article 209 of Regulation (EU, Euratom) No 966/2012 and Commission Delegated Regulation (EU) No 110/2014 (9).

C. whereas on 30 October 2015 the Commission adopted the delegated regulation (C(2015)07554) updating Delegated Regulation (EU) No 110/2014 on the model financial regulation for public-private partnership bodies referred to in Article 209 of Regulation No 966/2012 (aligning it with the corresponding provisions of Delegated Regulation (EU) No 1271/2013 applying to the bodies referred to in Article 208 of the Financial Regulation) with a view to its application from the beginning of the financial year, ensuring a clear-cut transition to the new rules;
C. considérant que, le 30 octobre 2015, la Commission a adopté le règlement délégué (C(2015)07554) modifiant le règlement délégué (UE) n° 110/2014 portant règlement financier type pour les organismes de partenariat public-privé visés à l'article 209 du règlement (UE) n° 966/2012 (afin de l'aligner sur les dispositions correspondantes du règlement délégué (UE) n° 1271/2013, qui s'applique aux organismes visés à l'article 208 du règlement financier), afin qu'il puisse s'appliquer dès le début de l'exercice financier, de manière à marquer clairement le passage aux nouvelles règles;
