3. The report shall be followed-up by proposals for amending this Directive, which the Commission deem necessary to adapt it - to the extent necessary for the smooth functioning of the internal market - to developments in the field of tobacco and related products, and to take into account new developments based on scientific facts and developments concerning internationally agreed standards for tobacco and related products.

3. The Commission, in its proposals envisaged in paragraph 1 concerning health, safety, environmental protection and consumer protection, will take as a base a high level of protection, taking account in particular of any new development based on scientific facts.

La Commission, dans ses propositions prévues au paragraphe 1 en matière de santé, de sécurité, de protection de l'environnement et de protection des consommateurs, prend pour base un niveau de protection élevé en tenant compte notamment de toute nouvelle évolution basée sur des faits scientifiques.

(1) Article 114 of the Treaty on the Functioning of the European Union (TFEU) provides that measures having as their object the establishment and functioning of the internal market and which concern inter alia health, safety and consumer protection must take as a base a high level of protection taking account in particular of any new development based on scientific facts.

In this respect, Article 114(3) TFEU explicitly requires that, in achieving harmonisation, a high level of protection of human health is to be guaranteed taking account in particular of any new development based on scientific facts.

That report shall be accompanied by any proposals for amendments to this Directive which the Commission deems necessary to adapt it to developments in the field of tobacco products, to the extent necessary for the establishment and operation of the internal market, and to take into account any new development based on scientific facts and developments on internationally agreed product standards.
Il est accompagné de toutes propositions de modification de la présente directive que la Commission juge nécessaires, en vue de son adaptation aux évolutions intervenues dans le domaine des produits du tabac, dans la mesure où cela s'avère nécessaire pour l'établissement et le fonctionnement du marché intérieur, et compte tenu de toute nouvelle évolution basée sur des faits scientifiques et des évolutions quant aux normes agréées sur le plan international pour les produits.

(4) In accordance with Article 95(3) of the Treaty, a high level of protection in terms of health, safety, environmental protection and consumer protection should be taken as a basis, regard being had, in particular, to any new developments based on scientific facts; in view of the particularly harmful effects of tobacco, health protection should be given priority in this context.
