(2) By judgement of the Court of Justice of the European Communities of 7 September 2006 in case C-310/04 Chapter 10a of Title IV of Regulation (EC) No 1782/2003 was annulled for breach of the principle of proportionality, in particular with reference to the circumstance that "the Council, the author of Regulation (EC) No 864/2004, [had] not shown before the Court that in adopting the new cotton support scheme established by that regulation it actually exercised its discretion, involving the taking into consideration of all the relevant factors and circumstances of the case, including all the labour costs linked to cotton growing and the viability of the ginning undertakings, which it was necessary to take into account for assessing the profitability of that crop" and that the Court had not been enabled "to ascertain whether the Community legislature [had been] able, without exceeding the bounds of the broad discretion it enjoys in the matter, to reach the conclusion that fixing the amount of the specific aid for cotton at 35% of the total existing aid under the previous support scheme would suffice to guarantee the objective set out in recital 5 in the preamble to Regulation (EC) No 864/2004, namely to ensure the profitability and hence the continuation of that crop, an objective reflecting that laid down in paragraph 2 of Protocol 4 ".

– (ES) Mr President, it is surprising that the response from the European Commission to the judgment of the Court of Justice was a new proposal amending the support scheme for cotton, which is practically identical to the previous one, except in relation to linking the support to the cotton harvested.
– (ES) Monsieur le Président, il est surprenant que la réponse de la Commission européenne à l’arrêt de la Cour de justice ait été une nouvelle proposition modifiant le régime de soutien au coton, proposition pratiquement identique à la précédente, sauf concernant le lien entre l’aide apportée et le coton récolté.

(4) The new scheme should meet the objectives, set out in paragraph 2 of Protocol No 4 on cotton annexed to the Act of Accession of Greece ("Protocol 4"), to support the production of cotton in regions of the Community where it is important for the agricultural economy, to permit the producers concerned to earn a fair income, and to stabilise the market by structural improvements at the level of supply and marketing.
(4) Il importe que ce nouveau régime permette d'atteindre les objectifs définis au paragraphe 2 du protocole n° 4 concernant le coton annexé à l'acte d'adhésion de la Grèce (ci-après dénommé "protocole n° 4"), à savoir d'apporter une aide à la production de coton dans les régions de la Communauté où elle est importante pour l'économie agricole, de garantir aux producteurs concernés un revenu équitable et de stabiliser le marché au moyen d'améliorations structurelles au niveau de l'offre et de la commercialisation.

In the current circumstances – which are encouraging for an industry that had felt gravely threatened by the reform – and taking into account the fact that, for reasons of legal certainty, the current arrangements will remain in force until a new support scheme is adopted that is proportional and in line with the principles of the reform, what action does the Commission intend to take on the matter? What will the timeframe for the new reform of the common organisation of the market in cotton be?
Dans une pareille situation, encourageante pour un secteur qui avait été grandement lésé par la réforme, et sachant que celle-ci restera en vigueur, pour des raisons de sécurité juridique, jusqu’à l’adoption d’un nouveau régime d’aide, proportionnel et conforme aux principes de la réforme, la Commission pourrait-elle dire ce qu’elle compte faire et quel sera le calendrier de cette nouvelle réforme de l’organisation commune de marché du coton?

For that reason, the Commission proposes to transfer the part of the EAGGF expenditure for cotton, which was destined to producer support during the reference period, into the funding of two producer income support measures, namely, the single farm payment scheme and a new production aid, granted as an area payment.
La Commission propose par conséquent de transférer la partie des dépenses du FEOGA pour le coton, destinée à l'aide aux producteurs au cours de la période de référence, vers le financement de deux mesures d'aide au producteur, à savoir, le régime de paiement unique par exploitation et une nouvelle aide à la production, accordée en tant que paiement à la surface.

Nevertheless, in view of the appreciable risk of production disruption, the Commission proposes that Member States will retain 40 % of the producer-support expenditure, during the reference period, as national envelopes, for the granting to producers of the new area payment per hectare of cotton, in zones suitable for that crop.
Néanmoins, eu égard au risque tangible de perturbation de la production, la Commission propose que les États membres conservent 40 % des dépenses d'aide aux producteurs, au cours de la période de référence, au titre des enveloppes nationales, pour accorder aux producteurs le nouveau paiement à la surface par hectare de coton dans les zones appropriées pour cette culture.

In that context, tobacco and cotton will be eligible for production-coupled support aimed at adapting to the new system.
