(2) Subject to subsections (3) and (4), if a network seller fails to satisfy any condition referred to in paragraphs 178(2)(a) to (c) for a fiscal year of the network seller in respect of which an approval granted under subsection 178(5) is in effect and, at any time during the fiscal year, a network commission would, if this Part were read without reference to subsection 178(7), become payable by the network seller to a sales representative of the network seller as consideration for a taxable supply (other than a zero-rated supply) made in Canada by the sales representative, the network seller shall, in determining the net tax for the first reporting period of the network seller following the fiscal year, add an amount equal to interest, at the prescribed rate, on the total amount of tax that would be payable in respect of the taxable supply if tax were payable in respect of the taxable supply, computed for the period beginning on the earliest day on which consideration for the taxable supply is paid or becomes due and ending on the day on or before which the network seller is required to file a return for the reporting period that includes that earliest day.

(5) If, at any time after an approval granted under subsection 178(5) in respect of a network seller and each of its sales representatives ceases to have effect as a consequence of a revocation under subsection 178(11) or (12), a network commission would, if this Part were read without reference to subsection 178(7), become payable as consideration for a taxable supply (other than a zero-rated supply) made in Canada by a sales representative of the network seller that has not been notified, as required under paragraph 178(13)(b), of the revocation and an amount is not charged or collected as, or on account of, tax in respect of the taxable supply, the network seller shall, in determining the net tax for the particular reporting period of the network seller that includes the earliest day on which consideration for the taxable supply is paid or becomes due, add an amount equal to interest, at the prescribed rate, on the total amount of tax that would be payable in respect of the taxable supply if tax were payable in respect of the taxable supply, computed for the period beginning on that earliest day and ending on the day on or before which the network seller is required to file a return for the particular reporting period.

(7) For the purposes of this Part, if, at any time when an approval granted under subsection (5) in respect of a network seller and each of its sales representatives is in effect, a network commission becomes payable by the network seller to a sales representative of the network seller as consideration for a taxable supply (other than a zero-rated supply) of a service made in Canada by the sales representative, the taxable supply is deemed not to be a supply.

(a) the consideration for a taxable supply (other than a zero-rated supply) of a service made in Canada by a sales representative of a network seller is a network commission that becomes payable by the network seller to the sales representative at any time after an approval granted under subsection (5) in respect of the network seller and each of its sales representatives ceases to have effect as a consequence of a revocation under subsection (11) or (12);

It should be built on: (a) draft document ‘SOPs for the HSC Network for the risk assessment and risk management of chemical events’ prepared by the Commission with input from the Chemical, Biological and Radio Nuclear (CBRN) Section of the Health Security Committee (HSC) and which is available as part of the outcomes of the CARRA-NET initiative; (b) input provided by the ‘Chemical and Radiation Risk Assessment Network (CARRA-NET)’ project that started in October 2010 under service contract No EAHC/2010/Health/12 for the implementation of framework contract No EAHC/2009/Health/06 Lot 2 concerning multiple framework contracts with reopening of competition on external assistance concerning activities in the area of health security ‘For establishing risk assessment networks of toxic industrial chemicals and radioactive threats and risks’ — the tender was awarded to the Health Protection Agency and the results will pave the way for establishing future networks for chemicals and radioactive threats; (c) lessons learnt from the three regional table top ‘IRIDIUM’ exercises on chemical events implemented in 2011 — the three exercises have been implemented under the specific subject ‘Chemical exercises’ under the framework contract No SANCO/C3-2007-01 (8); and (d) input provided by the initiative ‘Chemical and Radiological Inventory of Medical Countermeasures (CARIMEC)’ that was launched in December 2010 under service contract No EAHC/2010/Health/17 for the implementation of framework contract No EAHC/2009/Health/06 Lot 2 concerning multiple framework contracts with reopening of competition on external assistance concerning activities in the area of health security ‘For establishing an inventory of public health measures and medical countermeasures to respond to toxic industrial chemicals and radioactive threats and risks’. The CARIMEC initiative is carried out by the Health Protection Agency.

Where the SMP operator envisages to replace part of its existing copper access network with fibre and plans to de-commission currently used points of interconnection, NRAs should obtain the relevant information from the SMP operator, and should under Article 9(1) of Directive 2002/19/EC ensure that undertakings enjoying access to the SMP operator’s network receive all necessary information in timely fashion to adjust their own networks and network extension plans accordingly.

The Trans-European Transport Network Executive Agency (hereinafter referred to as the Agency) was set up by Commission Decision 2007/60/EC (2) of 26 October 2006, to manage the Community action in the field of the trans-European transport network until 31 December 2008 for the implementation of tasks concerning the granting of Community financial aid pursuant to Council Regulation (EC) No 2236/95 of 18 September 1995 laying down general rules for the granting of Community financial aid in the field of the trans-European networks (3).

The Commission notes the following regarding the presence of public resources in the acceptance by the broadcasting network operator of RTP's late payments for using the broadcasting network. By accepting non-payment of the network fee and interest, thereby giving rise to accumulated debt during the whole period under investigation, the network operator decided to forgo revenue and may have had to borrow money from the market in order to finance its operations.
