IV. TOLLS AND USER CHARGES a) Member States may maintain or introduce tolls and/or user charges subject to the following conditions without prejudice to any regulatory charges specifically designed to combat time and place- related traffic congestion : - they may not both be imposed at the same time on a vehicle for the use of a single road section; - they may not discriminate, directly or indirectly, on the grounds of the nationality of the haulier or of origin or destination of traffic; - they do not lead to the introduction or maintenance of mandatory checks or controls at frontiers; - with the exceptions proposed in Article 4.2 of the Commission proposal, they may apply only to motorways or other multi-lane roads with characteristics similar to motorways and, subject to a Community procedure, also other motor traffic roads and other sections of the primary road network where there are in particular safety reasons for doing so ; in a Member State where no general network of motorways or dual carriageways with similar characteristics exists, tolls or charges may apply to the highest category of road in that State; - a Member State may provide that vehicles registered in that State shall pay a user charge for the use of the whole road network in its territory.
IV. PEAGES ET DROITS D'UTILISATION a) Les Etats membres peuvent maintenir ou introduire des péages et/ou des droits d'utilisation, sous réserve des conditions suivantes, sans préjudice d'éventuels droits régulateurs destinés spécifiquement à remédier à des encombrements se produisant à certains endroits et à certains moments : - ces péages et droits ne peuvent être perçus en même temps sur un véhicule pour l'utilisation d'un même tronçon de route ; - ils ne peuvent pas entraîner de discrimination, directe ou indirecte, en raison de la nationalité du transporteur ou bien de l'origine ou de la destination du transport ; - ils ne doivent pas entraîner l'introduction ou le maintien de contrôles ou de vérifications obligatoires aux frontières ; - sous réserve des exceptions proposées à l'article 4 paragraphe 2 de la proposition de la Commission, ces péages et droits ne peuvent s'appliquer qu'aux autoroutes ou aux autres routes à plusieurs voies dont les caractéristiques sont analogues à celles des autoroutes et, sous réserve d'une procédure communautaire, également aux autres routes réservées aux véhicules à moteur et aux autres sections du réseau routier principal, lorsque des raisons de sécurité, notamment, le justifient ; dans un Etat membre dépourvu de réseau général d'autoroutes ou de routes à deux voies (chaussées séparées) ayant des caractéristiques similaires, les péages ou droits peuvent s'appliquer à la catégorie de route la plus élevée dans cet Etat membre ; - un Etat membre peut prévoir que les véhicules immatriculés dans cet Etat doivent payer un droit d'utilisation pour emprunter l'ensemble du réseau routier sur son territoire ; - les droits d'utilisation sont fixés par l'Etat membre concerné à un niveau qui ne dépasse pas 1 250 écus par an.
