The European Union deeply regrets that the US omnibus Appropriations Bill 2005, adopted by the US Senate on December 7, included the so-called Nethercutt Amendment.

Calls on the new US administration to reverse its strategy of undermining the International Criminal Court; deplores the adoption by the US Congress of the so-called 'Nethercutt' amendment to the 2005 budget, which revokes funds for those countries refusing to guarantee immunity from the ICC to American citizens suspected of having committed crimes against humanity, and urges President Bush to use the waiver powers he has been granted under that amendment;

Now it is clear that the Nethercutt amendment to the foreign operations appropriations bill will soon be passed by the US Congress, international criminal law and the International Criminal Court find themselves at a critical juncture because, as a result of that amendment, countries that refuse to sign bilateral immunity agreements with the United States will no longer be entitled to economic assistance.
Manifestement, le Congrès des États-Unis adoptera sous peu l’amendement Nethercutt déposé à la nouvelle loi sur les relations extérieures, ce qui place le droit pénal international et le tribunal pénal dans une situation difficile.
