The plaintiff refers, inter alia, to paragraphs in Kyrian in which it is held that the purpose of effective notification of all instruments and decisions that is inherent in Directive 76/308 cannot be attained unless it respects the legitimate interests of the addressees of notifications; that one of the functions of notification is to allow the addressee to assert his rights; that both the subject matter of the claim and the cause of action had to be identified with a degree of certainty (which entailed in Kyrian notification in the official language of the Member State in which the requested authority was situated) and that given that Directive 76/308 did not set out the consequences of failing to comply with this requirement ‘it is for the national court to apply national law while taking care to ensure the full effectiveness of Community law, a task which may lead it to interpret a national rule which has been drawn up with only a purely domestic situation in mind in order to apply it to the cross-border situation at issue’

Is the reference to the Court of Justice of the European Communities for a ruling on whether Article 8a of Council Directive 80/987/EEC of 20 October 1980 on the approximation of the laws of the Member States relating to the protection of employees in the event of the insolvency of their employer, (1) as amended by Directive 2002/74/EC of the European Parliament and of the Council of 23 September 2002, (2) which provides, in paragraph 1 thereof, that when an undertaking with activities in the territories of at least two Member States is in a state of insolvency, the institution responsible for meeting employees’ outstanding claims is to be that in the Member State in whose territory they work or habitually work and, in paragraph 2 thereof, that the extent of employees’ rights is to be determined by the law governing the competent guarantee institution, is to be interpreted as designating the competent institution to the exclusion of any other, or whether, having regard to the purpose of the Directive, which is to strengthen the rights of workers exercising their right to freedom of movement, and to the first paragraph of Article 9 of the Directive, under which the Directive is not to affect the option of Member States to apply or introduce laws, regulations or administrative provisions which are more favourable to employees, it is to be interpreted as not depriving the employee of the right to take advantage, in the place of that institution’s guarantee, of a more favourable guarantee from the institution with which his employer is insured and to which it makes contributions under national law?
L'article 8 bis de la directive no 80/987/CEE du Conseil, du 20 octobre 1980, concernant le rapprochement des législations des États membres relatives à la protection des travailleurs salariés en cas d'insolvabilité de l'employeur (1), telle que modifiée par la directive no 2002/74/CE du Parlement européen et du Conseil, du 23 septembre 2002 (2), qui prévoit dans son premier alinéa que, lorsqu'une entreprise ayant des activités sur le territoire d'au moins deux États membres se trouve en état d'insolvabilité, l'institution compétente pour le paiement des créances impayées des travailleurs est celle de l'État membre sur le territoire duquel ils exercent ou exerçaient habituellement leur travail et, dans son deuxième alinéa, que l'étendue des droits des salariés est déterminée par le droit régissant l'institution de garantie compétente, doit-il être interprété comme désignant l'institution compétente à l'exclusion de toute autre, ou, compte tenu de la finalité de la directive, qui est de consolider les droits des travailleurs faisant usage de leur liberté de circulation et du premier alinéa de l'article 9 de cette même directive, aux termes duquel elle ne porte pas atteinte à la faculté des États membres d'appliquer ou d'introduire des dispositions législatives, réglementaires ou administratives plus favorables aux travailleurs salariés, doit-il être interprété comme ne privant pas le salarié du droit de se prévaloir, en lieu et place de la garantie de cette institution, de celle plus favorable de l'institution auprès de laquelle son employeur s'assure et cotise en application du droit national?

3. The Member States shall regularly send relevant information concerning the national interpretation and application of this Regulation to the Commission, which will make this information available in electronic form to other Member States.

It has to be said that the present wording of Articles 7 to 10 has allowed the application of national interpretations which, depending on the Member State, are framed more liberally or more restrictively than the provisions of those Articles.

3.6.2. Therefore, although the Member States would be obliged, under the present proposals, to forego some of the options which they currently have to impose limitations on the right to deduct and apply national interpretations to the definition of what constitutes an allowable business expense for VAT purposes, this can be justified by the need to eliminate or reduce distortions of competition.
