As regards the grade in which a member of staff seconded from a Member State’s national diplomatic service is placed upon his appointment by an EU body as a member of its temporary staff, the functions previously performed by the person concerned as a seconded national expert within that same body cannot be taken into consideration for the purposes of comparison with the functions corresponding to the post occupied as a member of the temporary staff since, as a seconded national expert, he was not eligible for grading under the Staff Regulations.

2. Before any meeting which they are to attend, Members of the Administrative Board and of the Security Accreditation Board, the Executive Director, as well as seconded national experts and observers and external experts participating in ad hoc working groups shall accurately and completely declare the absence or existence of any interest which might be considered prejudicial to their independence in relation to any items on the agenda, and shall abstain from participating in the discussion of and voting upon such points.

The duties carried out shall be defined by mutual agreement between the EEAS and the administration which seconds the national expert in the interest of the EEAS and taking into account the SNE’s qualifications.

The secondment of national experts from the Member States to the CEPOL Secretariat shall be in accordance with Council Decision 2003/479/EC of 16 June 2003 concerning the rules applicable to national experts and military staff on secondment to the General Secretariat of the Council , which shall apply by analogy.

The secondment of national experts from the Member States to the CEPOL Secretariat shall be in accordance with Council Decision 2003/479/EC of 16 June 2003 concerning the rules applicable to national experts and military staff on secondment to the General Secretariat of the Council (4), which shall apply by analogy.

Before the period of secondment begins, the employer from which the national expert is to be seconded shall certify to the GSC that, throughout the period of secondment, the SNE will remain subject to the social security legislation applicable to the public administration or international organisation which employs the SNE and which will assume responsibility for expenses incurred abroad.
