IN-CONTEXT TRANSLATIONS

On Thursday 10 April, the delegation will hold three working sessions with the judges of the Constitutional Court, the Supreme Court and the Supreme Administrative Court; the first working session will cover administrative penalties and criminal penalties in the case-law of the Court of Justice of the EU and that of the Constitutional Court, the second will cover the application of the Charter of Fundamental Rights in the Member States of the EU and the third, the dialogue between national judges and the Court of Justice.
Le jeudi 10 avril, la délégation tiendra trois sessions de travail avec les juges de la Cour constitutionnelle, de la Cour Suprême et de la Cour Administrative Suprême, portant, pour la première, sur les sanctions administratives et sanctions pénales dans la jurisprudence de la Cour de justice de l’UE et celle de la Cour constitutionnelle, pour la seconde, sur l’application de la Charte des droits fondamentaux dans les États membres de l’UE et, pour la troisième, sur le dialogue entre les juges nationaux et la Cour de justice.

The delegation held two working sessions with the Federal Constitutional Court concerning, in the first, the relation between European protection and national protection of basic rights and, in the second, citizenship of the European Union.

The national court therefore retains that option – even though a national rule obliges it to follow the legal position of the Slovak Constitutional Court – and it must set aside the assessments made by that latter court if they prove to be contrary to EU law.

It took the view that the Charter is enforceable in the proceedings brought before it for the judicial review of national legislation, and therefore individuals can rely upon the rights and the principles recognised in the Charter when challenging the lawfulness of domestic legislation. The Austrian Constitutional Court identified strong similarities between the role played by the Charter in the EU legal system and that played by the ECHR under the Austrian Constitution, according to which the ECHR has force of constitutional law.
De l’avis de la juridiction constitutionnelle autrichienne, la Charte est opposable dans les procédures de contrôle juridictionnel de la législation nationale dont elle est saisie; par conséquent, les justiciables peuvent se prévaloir des droits et des principes reconnus dans la Charte lorsqu’ils contestent la légalité d’une législation de droit interne. These commitments include the repeal of emergency ordinances regarding the powers of the Constitutional Court and the eligibility rules for the referendum on the impeachment of President Basescu, the respect for decisions of the Constitutional Court and of the Romanian Constitution, and to the appointments procedure for key positions including the Ombudsman, the General Prosecutor of Romania and the Chief Prosecutor of the National Anti-Corruption Directorate.

A round table discussion on the role of the Court of Justice within the Community legal order and on the relations of the Court of Justice with the national constitutional courts was organised on the first day of the visit, and this was attended by the President of the Court of Justice and by other members.

There is a newly appointed independent network of experts on fundamental rights commissioned by DG-Justice and Home Affairs "to assess how each of the rights listed in the CFREU is applied at both national and Community levels.[taking] account of developments in national legislation, the case law of constitutional courts [...] as well as the case law of the Court of Justice of the European Communities and the European Court of Human Rights".

The German constitutional court found that the rules governing access to and the use of the data, as laid down in national law, were unconstitutional.[43] The Romanian constitutional court found that data retention per se breached Article 8 of the Convention for the Protection of Human Rights and Fundamental Freedoms (European Convention on Human Rights) and was thus unconstitutional.[44] The Commission is currently evaluating this instrument and is to submit its assessment report to the European Parliament and the Council in late 2010.
La Cour constitutionnelle allemande a estimé que les dispositions régissant l’accès aux données ainsi que leur utilisation, telles que figurant dans la législation nationale, étaient anticonstitutionnelles[43]. La Cour constitutionnelle roumaine a jugé que la conservation de données était en soi contraire à l’article 8 de la convention de sauvegarde des droits de l'homme et des libertés fondamentales (convention européenne des droits de l’homme) et était donc anticonstitutionnelle[44]. La Commission procède actuellement à l’évaluation de cet instrument et doit présenter son rapport d’évaluation au Parlement européen et au Conseil à la fin 2010.
