Reducing its prices for retail sugar to the extent that an insufficient margin existed between its prices for retail and industrial sugar, therefore making it impossible for Napier Brown to repackage industrial sugar and sell it for retail sale at a profit. 3. Offering sugar on a delivered price basis only. 4. Discriminating against Napier Brown by refusing to supply it exclusively beet origin sugar whereas it supplied exclusively beet origin sugar to other purchasers at their request.

Following discussions between British Sugar and Commission officials, held at the request of British Sugar, British Sugar has offered the following undertakings to the Commission, whilst reserving its position upon the facts and allegations contained in the Statement of Objections: (1) British Sugar agrees to supply a quantity of standard industrial sugar to Napier Brown on terms and conditions acceptable to the Commission (2) British Sugar will not seek to enter into any agreement with a customer whereby the customer agrees not to purchase products of Whitworths Ltd; (a shareholder in Napier Brown and the company which packages sugar for Napier Brown) (3) Regarding British Sugar's pricing policy, British Sugar has given the following undertaking to the Commission: "British Sugar accepts the need for sugar merchants and believes that they have a useful function to perform in the UK market.
