On the sub-question on pensions, the Council would like to point out that the common objectives agreed for the new open method of co-ordination in the area of pensions include raising employment as a way of ensuring the financial sustainability of pension systems.

As clearly stated in its answer to the letter in question, the Commission limited its action to the provision of factual information, using a document, “Guide to the Nice Treaty”, made available in all 11 official languages, and on the Europa website, for the information of European citizens, without discrimination, throughout the community. This is without prejudice of the right of individual Commissioners to express their personal views on any matter relevant to the EU.

Regarding extradition, it follows from the European Convention on Human Rights and the 1957 European Convention on Extradition, and is indeed normal practice within the European Union, that Member States do not extradite individuals to countries where the death penalty is still enforced. Individuals are only extradited if a guarantee is obtained ensuring that if the person in question is found guilty, the death penalty will not be called for and certainly not enforced. As for military tribunals, the Union does not have an official position on the subject. It is, however, clear that extradition to countries where the requirements for a just and fair trial could not be met would present a political problem for Member States.

IV. IMPROVING THE EFFECTIVENESS OF THE INSTITUTIONS Four questions arise when considering ways of improving the effectiveness of the institutions: - the question of broadening the Community's powers; - the question of subsidiarity; - the question of improving the way the institutions operate while maintaining a general balance; - the question of the status of the Community's public finances. -11- 1. Powers As in the case of the Single Act, the question of powers must not be seen in general terms but rather in terms of selecting the means of action the Community needs to ensure the balanced development of common policies.
IV. L'AMELIORATION DE L'EFFICACITE DES INSTITUTIONS L'amélioration de l'efficacité des institutions soulève quatre séries de questions : - celle de l'élargissement des compétences de la Communauté - celle de la subsidiarité - celle d'un meilleur fonctionnement des institutions dans le respect d'un équilibre général - celle du statut des finances publiques -11- 1) Compétences : La question des compétences doit être appréhendée, comme pour l'Acte unique, non pas en termes généraux mais en fonction d'une sélection des besoins en moyens d'action communautaire pour permettre un développement équilibré des politiques communes.
