IN-CONTEXT TRANSLATIONS

Taking account of the Council conclusions on intensified cooperation on the management of migration flows with third countries adopted in November 2002, the Commission considers that Article 13 of the Cotonou Agreement provides a comprehensive and balanced agenda for action, which could serve as a model for migration clauses to be negotiated in future agreements with other third countries.

Considers that the Energy Union entails negotiating with one voice with third countries; calls on the Commission to analyse the appropriateness and potential structure of a voluntary collective purchasing mechanism and its impact on the functioning of the internal gas market, the undertakings affected and its contribution to ensuring security of gas supply; notes that since there are several models of collective purchasing mechanisms, further work needs to be done to determine the best market-based model applicable for EU regions and suppliers concerned and for the conditions under which a voluntary collective purchasing mechanism could be launched; considers that the coordination of positions and the collective purchasing of gas should start at regional level; recommends, in the interim, that the Commission and the Energy Community Secretariat support those Member States and Energy Community Contracting Parties, respectively, that wish to negotiate energy contracts on a voluntary basis, in compliance with the EU internal market acquis and with EU competition and World Trade Organisation rules, and provide for protection of commercially sensitive information; underlines that energy contracts must be based upon market prices and competition;

In these second-generation models, the use of telematic tools and assistance from artificial intelligence based on mathematical models facilitate rulings on disputes through the systematic evaluation of the parties' proposals, in turn supported by IT specialists with equal capacity (‘intelligent interfaces’) in a interactive process based on standard negotiating patterns such as BATNA (Best Alternative to a Negotiated Agreement), WATNA (Worst Alternative to a Negotiated Agreement) and finally ZOPA (Zone of Possible Agreement). Examples of decision support systems include expert systems, systems of information based on previous cases, computer database access systems (case-based reasoning or ‘CBR’ in international literature) and online dispute resolution based on the parties' different approaches to dispute resolution.

– (DA) Madam President, the developments we have seen in the labour market in the light of the very far-reaching Rüffert, Laval and Waxholm judgments are in stark contrast to the desire to introduce the flexicurity model as an economic model for Europe, as it seems to be completely forgotten that this very flexicurity model is based on a century-long tradition of the labour market having had the right to negotiate robust and independent agreements.

Other third countries: In view of the large number of applications and the need for a consistent approach, the Commission is proposing that the Council in the near future adopt a negotiating directive in the form of a model agreement that can be used for all third countries rather than taking each third country individually.

As regards the latter, both companies and unions report that the SE Statute offers the possibility to: (i) negotiate an employee involvement model, thereby tailoring it to the specific needs of the company or group, instead of having to comply with mandatory national rules; (ii) have a mixture of representatives from different Member States instead of representatives only from one Member State (this can help to build a European employee consciousness and could be an advantage for European wide groups); and (iii) reduce the size of the supervisory board to increase its efficiency.

– (FR) I shall not go into the details, but these are, in fact, the sort of considerations which justify our rejecting attacks which may have been made on the common agricultural policy and our own system, and that is also the reason why the European Union adopted an overall negotiating mandate designed to safeguard the social model and the farm model, not to mention the European cultural model, with regard to the WTO.
