In order to allow the Joint Undertakings to benefit immediately from the simplifications introduced in the new financial framework, it is necessary that the Commission delegated regulation of 30 September 2013 on the model financial regulation for PPP bodies under Article 209 of the Financial Regulation enters into force.

C. whereas on 30 October 2015 the Commission adopted the delegated regulation (C(2015)07554) updating Delegated Regulation (EU) No 110/2014 on the model financial regulation for public-private partnership bodies referred to in Article 209 of Regulation (EU, Euratom) No 966/2012 (aligning it with the corresponding provisions of Delegated Regulation (EU) No 1271/2013 applying to the bodies referred to in Article 208 of the Financial Regulation) with a view to its application from the beginning of the financial year, ensuring a clear-cut transition to the new rules;
C. considérant que, le 30 octobre 2015, la Commission a adopté le règlement délégué (C(2015)07554) modifiant le règlement délégué (UE) n° 110/2014 portant règlement financier type pour les organismes de partenariat public-privé visés à l'article 209 du règlement (UE, Euratom) n° 966/2012 (afin de l'aligner sur les dispositions correspondantes du règlement délégué (UE) n° 1271/2013, qui s'applique aux organismes visés à l'article 208 du règlement financier), afin qu'il puisse s'appliquer dès le début de l'exercice financier, de manière à marquer clairement le passage aux nouvelles règles;

15. Takes into consideration that the new Financial Regulation applicable to the general budget of the Union was adopted on 25 October 2012 and took effect on 1 January 2013 while the model financial regulation for public-private partnership bodies referred to in Article 209 of the new Financial Regulation did not enter into force until 8 February 2014; notes that the Joint Undertaking's financial rules have not been amended to take into account the model financial regulation because of the merger into the ECSEL Joint Undertaking;

13. Takes into consideration that the new Financial Regulation applicable to the general budget of the Union was adopted on 25 October 2012 and took effect on 1 January 2013 while the model financial regulation for public-private partnership bodies referred to in Article 209 of the new Financial Regulation did not enter into force until 8 February 2014; acknowledges that the Financial Rules of the Joint Undertaking have been amended to take into account the model financial regulation in July 2014;

The financial rules of those bodies shall not depart from the model financial regulation except where their specific needs so require and with the Commission's prior consent.

The Commission shall be empowered to adopt a model financial regulation by means of a delegated act in accordance with Article 210 which shall lay down the principles necessary to ensure sound financial management of Union funds and which shall be based on Article 60.
