In order to avoid the premature obsolescence of articles that are no longer produced after the sunset dates referred to Annex XIV to Regulation (EC) No 1907/2006, some substances (by themselves or in mixtures) included in that Annex need to be available for the production of spare parts for the repair of those articles, where those articles cannot function as intended without those spare parts, as well as where some Annex XIV substances (by themselves or in mixtures) are necessary for the repair of such articles.

2. Notwithstanding paragraph 1, the substances listed in Annex I, or mixtures or substances containing those substances, may be made available to, possessed and used by members of the general public in concentrations higher than those set out in that Annex, provided that the member of the general public obtains, and, if requested, presents a licence for acquiring, possessing or using the substance, or mixture or substance containing the substance, in concentrations higher than those laid down in Annex I, issued in accordance with Article 5 by a competent authority of the Member State where that substance or mixture or substance containing the substance is going to be acquired, possessed or used.
2. In any case, whatever their use or intended final purpose, the placing on the market of the above mixtures, articles or components of articles manufactured from polymers or copolymers of vinyl chloride, stabilised by substances containing cadmium is prohibited, if their cadmium content (expressed as Cd metal) exceeds 0,01 % by weight of the polymer.

1. Any manufacturer or importer, or group of manufacturers or importers, hereinafter “the notifiers”, who places on the market a substance subject to registration in accordance with Regulation (EC) No 1907/2006 or a substance classified as hazardous on its own or in a mixture above the concentration limits specified inDirective 1999/45/EC or in this Regulation, where relevant, which results in the classification of the mixture as hazardous, shall notify to the Agency the following information in order for it to be included in the inventory referred to in Article 43:
1. The supplier of a mixture referred to in Article 24 shall update the label without delay following any change to the classification of the substance and the labelling of the mixture.

Where the manufacturer only has the information provided by the supplier(s) of the substances used in the product (mixture), he will rely on the establishment of the classification of the mixture from an evaluation of information by the procedure given in Article 9 paragraph 4.

mixtures, not classified under one single entry in Annex III, of two or more wastes listed in Annex III, provided that the composition of these mixtures does not impair their environmentally sound recovery and provided that such mixtures are listed in Annex IIIA, in accordance with Article 58 .
