57. Criticises the fact that the issue of Western Sahara has not been placed on the agenda for the 2016 sessions of the HRC; emphasises once again that the Western Sahara conflict is a decolonisation issue and that, under international law, the Kingdom of Morocco has no sovereignty over Western Sahara and is regarded as the occupying power; condemns the persistent violation of the fundamental rights of the Sahrawi people; calls for the protection of the fundamental rights of the people of Western Sahara, including freedom of association, freedom of expression and the right to demonstrate; calls for the immediate release of all Sahrawi political prisoners and, as a matter of urgency, of the members of the Gdeim Izik group condemned by the Moroccan military tribunal; repeats its call to Spain to grant political asylum to the young Sahrawi Hassana Aalia, sentenced by a court to life imprisonment; stresses the need for international monitoring of the human rights situation in Western Sahara; calls on Morocco and the Polisario Front to continue the negotiations which are designed to lead to a peaceful and lasting solution to the Western Sahara conflict, and reaffirms the right of the Sahrawi people to self-determination, which must be decided by a democratic referendum held in accordance with United Nations Resolutions 34/37 and 35/19;

Welcomes Serbia’s cooperation with the ICTY, which has resulted in all war crimes suspects being handed over to the Hague Tribunal for trial; encourages further cooperation with the Tribunal; endorses the repeated calls by the ICTY chief prosecutor for the thorough investigation and prosecution of the persons engaged in the support networks which enabled fugitives to remain at large for so long, particularly in the military and civilian security services; notes that domestic war crimes prosecutions have proceeded steadily, but draws attention to the need to deal more vigorously with the issue of missing persons; furthermore calls on the authorities to ensure the credibility and professionalism of the Witness Protection Programme (WPP) and to provide it with adequate resources so that the judiciary can effectively continue its proceedings on war crimes; draws attention to the fact that a number of former police officers voluntarily opted out of the WPP because of its considerable shortcomings;
11. se félicite de la coopération de la Serbie avec le TPIY, grâce à laquelle toutes les personnes soupçonnées de crimes de guerre ont été remises au Tribunal de La Haye pour y être traduites en justice; encourage la poursuite de la coopération avec le Tribunal; se joint aux appels répétés du procureur général du TPIY pour que des enquêtes minutieuses soient menées et que des poursuites soient engagées contre les personnes ayant participé aux réseaux de soutien qui ont permis aux fugitifs de demeurer si longtemps en liberté, en particulier dans les services de sécurité militaires ou civils; relève que les poursuites en matière de crimes de guerre nationaux ont avancé de manière constante, mais attire l'attention sur la nécessité de redoubler d'efforts dans les affaires concernant les personnes disparues; demande en outre aux autorités de veiller à la crédibilité et au professionnalisme du programme de protection des témoins et d'y allouer des ressources suffisantes afin que la justice puisse continuer à faire son œuvre en matière de crimes de guerre; attire l'attention sur le fait qu'un certain nombre d'anciens officiers de police ont volontairement choisi de ne pas bénéficier du programme de protection des témoins en raison des nombreux défauts qu'il présente;

– (ES) Mr Carnero González was present in the Committee on Foreign Affairs, Human Rights, Common Security and Defence Policy when I said, quite clearly and unambiguously, and I am honoured to be able to repeat this here today, that the European Union will never – I repeat – never, allow any European citizen to be extradited, under any kind of agreement with the United States, whilst there is no guarantee of two things – not one, but two – that the death penalty would never be applied, and that they would never be judged by one of these military tribunals that have recently been set up since 11 September.

Carnero siégeait à la commission des affaires étrangères, des droits de l'homme, de la sécurité commune et de la politique de défense de cette Assemblée lorsque j'ai dit, de manière absolument claire et définitive, ce que je me fais un point d'honneur de répéter, que l'Union européenne ne consentira jamais - je répète - jamais à l'extradition d'aucun citoyen européen, quelle que soit la convention avec les États-Unis, tant que nous ne disposerons pas deux garanties - pas une, mais bien deux - : que la peine de mort ne pourra en aucun cas être appliquée et que ce citoyen ne pourra pas être jugé par un des tribunaux militaires qui viennent d'être créés après le 11 septembre.
