The Council adopted a Regulation re-imposing an anti-dumping duty of 41.1% on imports of 3.5" microdisks produced and sold for export to the EC by an Indonesian company, PT Betadiskindo Binatama.

Further to the findings of the partial review of Regulation No 577/91 carried out by the Commission, the purpose of this amendment is to exempt EPROMS produced under the agreement between Intel and NPNX and subsequently exported by Intel from the definitive duty; - by a qualified majority (the Luxembourg and United Kingdom delegations voting against) the Regulation imposing a definitive anti-dumping duty on imports of certain magnetic discs (3,5" microdisks) originating in Japan, Taiwan and the People's Republic of China, and collecting definitively the provisional duty imposed.
Cette modification, suite aux conclusions d'un réexamen partiel du règlement n° 577/91 effectué par la Commission, vise à exonérer du droit définitif instauré par ce règlement les "EPROMs" fabriqués dans le cadre de l'accord entre Intel et NPNX et exportés ensuite par Intel ; - à la majorité qualifiée (les délégations du Luxembourg et du Royaume- Uni ont voté contre) le règlement instituant un droit antidumping définitif sur les importations de certains disques magnétiques (microdisques de 3,5 pouces) originaires du Japon, Taïwan et de la République populaire de Chine et portant perception définitive du droit provisoire.

In 1998 the Council had imposed a definitive anti-dumping duty on imports of such microdisks (Reg (EC) No 1821/98), but further to a request by Betadiskindo Binatama, which argued that it was not related to any of the producers in Indonesia subject to these duties, and that it had not exported this product to the EC during the period of investigation, the Commission initiated a review to determine whether this company should be considered as a "new exporter", and repealed the anti-dumping duty with regard to this company.
En 1998, le Conseil a institué un droit antidumping définitif sur les importations de ces disques magnétiques (règlement (CE) n° 1821/98) mais, suite à une demande de Betadiskindo Binatama, qui a fait valoir qu'elle n'est liée à aucun des exportateurs ou des producteurs indonésiens soumis aux mesures antidumping en vigueur sur les produits concernés et allégué qu'elle n'avait pas exporté les produits concernés vers la Communauté au cours de la période d'enquête initiale, la Commission a réexaminé la question afin de déterminer si cette société devrait être considérée comme un "nouvel exportateur" et a abrogé le droit antidumping pour cette société.
