10. Welcomes the constitutional amendments aimed at strengthening the independence of the judiciary by reducing political influence on the appointment of prosecutors and judicial officials at all levels through more transparent and merit-based procedures, and specifically by electing the Supreme State Prosecutor; takes note, however, of the Ombudsman’s initiative for assessing the constitutionality of these amendments and of the provisions of the law on the Constitutional Court concerning the election of Constitutional Court Judges; calls on the competent authorities to establish a solid track record of disciplinary proceedings and to ensure timely justice, together with the unification of jurisprudence; calls for further legislative and other measures to be taken and implemented in order to diminish the politicisation of the judiciary in practice, including through objective evaluation of judicial performance, clear demonstration of judicial accountability in line with the recommendations of the Venice Commission, and the guaranteeing of merit-based promotions; underlines also the need to ensure the independence of misdemeanour courts from the executive branch;
10. se félicite des modifications constitutionnelles destinées à accroître l'indépendance du système judiciaire en limitant l'influence politique à tous les niveaux lors de la nomination des juges et des hauts fonctionnaires de justice, grâce à des procédures plus transparentes et fondées sur le mérite, et plus spécifiquement par l'élection du parquet général de l'État; prend toutefois acte de l'initiative du médiateur visant à évaluer le caractère constitutionnel de ces modifications et des dispositions de la loi sur la Cour constitutionnelle en ce qui concerne l'élection des juges de ladite Cour; demande aux autorités compétentes d'obtenir des résultats probants dans le cadre des procédures disciplinaires et de garantir une mise en œuvre rapide de la justice, de même que l'unification de la jurisprudence; demande que des mesures supplémentaires d'ordre législatif et autre soient prises et mises en œuvre afin de limiter, dans la pratique, la politisation de la justice, notamment par le biais d'une évaluation objective de la performance judiciaire, d'une démonstration claire de la responsabilité judiciaire conforme aux recommandations de la commission de Venise et de la garantie de promotions fondées sur le mérite; souligne également la nécessité de garantir l'indépendance des tribunaux correctionnels vis-à-vis du pouvoir exécutif;

Without prejudice to the principle of promotion based on merit as laid down in Article 45, this plan shall ensure that for each institution, the number of vacant positions at every grade of the establishment plan on 1 January of each year corresponds to the number of officials in the lower grade in active employment on 1 January of the preceding year, multiplied by the rates laid down in Annex I, point B, for that grade. These rates shall be applied on a five-year average basis as from 1 January 2013.

Sans préjudice du principe de promotion fondée sur le mérite, énoncé à l'article 45, ce tableau garantit que, pour chaque institution, le nombre d'emplois vacants pour chaque grade est égal, au 1 janvier de chaque année, au nombre de fonctionnaires en activité au grade inférieur au 1 janvier de l'année précédente, multiplié par les taux fixés, pour ce grade, à l'annexe I, section B. Promotion shall be exclusively by selection from among officials who have completed a minimum of two years in their grade after consideration of the comparative merits of the officials eligible for promotion.

For the purposes of this Decision, “public figure” shall mean any person, either in an official capacity or in a non-official position who is deemed to be under threat because of his or her contribution to or impact on the public debate, and who, in the view of the Member State concerned, merits protection, and to whom a protection service is assigned in accordance with the national legislation of a Member State or pursuant to the regulations of an international or supranational organisation or institution’.

I have been wondering since September, Vice-President, how it could be that such objective, such perfect, such universally acceptable criteria of competence, merit and so forth were met solely, surprise surprise, by officials living in or originally from certain island countries, while these same qualities did not appear to be present in officials from other, more misshapen countries – boot-shaped countries, for example.
