1. The Commission shall, in collaboration with the Member States, set up and manage a computerised information management system for official controls (IMSOC) for the integrated operation of the mechanisms and tools through which data, information and documents concerning official controls and other official activities are managed, handled, and automatically exchanged.

3. Is of the opinion that the EU should follow the example of the United States in enacting the Sergei Magnitsky Rule of Law Accountability Act of 2012 and adopt similar legislation at EU level, as an emblematic and operational framework establishing the link between corruption and breaches of human rights; calls, therefore, on the Council to adopt a decision establishing a common EU list of officials involved in the death of Sergei Magnitsky, in the subsequent judicial cover-up and in the ongoing and sustained harassment of his family; adds that this Council Decision should impose targeted sanctions on those officials, such as an EU-wide visa ban and a freezing order on any financial assets that they or their immediate family may hold inside the European Union; calls on the Commission to draw up an action plan, with a view to creating a mechanism for listing and imposing similar targeted sanctions against officials of third countries (including police officers, prosecutors and judges) involved in grave human rights violations and judicial ‘ manipulations’ against whistleblowers, journalists reporting on corruption and human rights activists in third countries; stresses that criteria of inclusion on the list should be built up on the basis of well-documented, converging and independent sources and convincing evidence, allowing for mechanisms of redress for those targeted;
3. est d'avis que l'Union européenne devrait suivre l'exemple des États-Unis, qui ont adopté la loi Sergueï Magnitski en 2012, et introduire une législation similaire au niveau de l'Union, en tant que cadre emblématique et opérationnel établissant le lien entre la corruption et les violations des droits de l'homme; invite dès lors le Conseil à adopter une décision établissant une liste européenne commune des fonctionnaires impliqués dans la mort de Sergueï Magnitski, la dissimulation judiciaire ultérieure et harcèlement continu et constant de sa famille; ajoute que cette décision du Conseil devrait imposer des sanctions ciblées à ces fonctionnaires, comme une interdiction de visa à l'échelle européenne et le gel de tous leurs avoirs financiers éventuels et de ceux de leurs proches immédiats à l'intérieur de l'Union européenne; invite la Commission à élaborer un plan d'action en vue de créer un mécanisme recensant, d'une part, les fonctionnaires de pays tiers (notamment des policiers, procureurs et juges) impliqués dans des violations graves des droits de l'homme et dans des «manipulations» judiciaires contre les dénonciateurs d'abus, les journalistes dénonçant la corruption et les militants des droits de l'homme dans les pays tiers et imposant, d'autre part, des sanctions ciblées similaires à leur encontre; souligne que les critères d'inscription sur la liste ainsi créée devraient reposer sur des sources bien documentées, convergentes et indépendantes, et sur des preuves convaincantes, ainsi que prévoir des mécanismes de recours pour les personnes visées;

Welcomes current cooperation between the existing protection mechanisms at European and international level, which could be further strengthened through systematic exchange of information and strategy, so as to ensure a better complementarity between all of them in terms of both sharing information for emergency cases and coordination for long-term support actions, e.g. through the use of a secure online platform accessible to all official stakeholders; welcomes in this respect the annual meetings organised by the Council of Europe as well as the ‘inter-mechanisms’ annual meetings organised by the Observatory for the Protection of Human Rights Defenders, a joint programme of the International Federation for Human Rights (FIDH) and the World Organisation Against Torture (OMCT), with the aim of strengthening the interaction between international and regional mechanisms and institutions for the protection of human rights defenders; invites the existing taskforces on human rights defenders in Europe, within the framework of the Council Working Party on Human Rights and the Council of Europe - the latter being an initiative of the Council of Europe's Commissioner for Human Rights - to explore ways to work more closely together;

The objective of this Recommendation is to encourage the Member States to ensure that the necessary steps are taken in order to effectively interconnect the officially appointed mechanisms for the central storage of regulated information, as referred to in Article 21(2) of Directive 2004/109/EC (hereinafter ‘the storage mechanisms’), in a single electronic network within the Community, as referred to in point (b) of second subparagraph of Article 22(1) of that Directive (hereinafter ‘the electronic network’).

Your rapporteur considers that a balance must be ensured between aid-derived income and price-derived income and therefore proposes that public intervention should be maintained as the regulation mechanism, with an official price that guarantees both competitiveness and genuine protection against the volatility of world prices.
