IN-CONTEXT TRANSLATIONS

Particular focus will be on possibilities of: (1) simplifying and speeding up the registration procedure, taking into account the requirements of the electronic age; (2) increasing legal certainty, such as by redefining what may constitute a trade mark; (3) clarifying the scope of trade mark rights inter alia as regards goods in various situations throughout the EU customs territory; (4) providing a framework for increased cooperation between the Office for Harmonisation in the Internal Market (OHIM) at Alicante and national trade mark offices with the aim of harmonising administrative practice and developing common tools, such as those which offer far greater options for conducting priority searches, and watching the registry for infringing registrations; and (5) making the Directive more coherent with the Regulation, in particular, by further aligning the legal grounds of refusal for registration at European level, and (6) aligning the grounds for refusal and for coexistence under both the Directive and the Regulation to rules on geographical indications.

We will continue our work across the 10 priorities through 21 new initiatives: (1) to boost jobs, growth and investment we will propose a Youth Initiative, an Action Plan on the implementation of the Circular Economy and a new Multi-annual financial framework; (2) we will carry out a mid-term review of the Digital Single Market; (3) we will implement the Energy Union Strategy with work on low-emission vehicles and mobility; (4) we will build a deeper and fairer internal market by implementing the Single Market Strategy, Space Strategy for Europe and Capital Markets Union Action Plan and making proposals for Fairer taxation of companies; (5) we will present ideas for the reform of the EU at 27 and the strengthening of the Economic and Monetary Union and we will propose a European Pillar of Social Rights; (6) we will implement the Trade for All Strategy and pursue trade negotiations with our partners while strengthening our trade defence instruments; (7) we will continue to pursue a Security Union to fight terrorism and will align the rules on the protection of personal data and privacy; (8) we will deliver on the European Agenda on Migration; (9) to strengthen Europe's role as a global actor, we will present a European Defence Action Plan including a European Defence Fund, and the Commission and the High Representative will adopt an EU Strategy for Syria and implement the EU Global Strategy and Africa-EU Partnership; (10) we will adapt existing laws to the Treaty provisions on delegated and implementing acts and will assess the democratic legitimacy of existing procedures for adopting certain secondary EU acts.

The Commission should be empowered to adopt delegated acts in accordance with Article 290 TFEU in respect of technical adjustments to Directive 2006/48/EC to clarify definitions to ensure uniform application of that Directive or to take account of developments on financial markets; to align terminology on, and frame definitions in accordance with, subsequent relevant acts; to expand the content or adapt the terminology of the list of activities subject to mutual recognition under that Directive to take account of developments on financial markets; to adjust the areas in which the competent authorities are required to exchange information; to adjust the provisions of that Directive on own funds to reflect developments in accounting standards or Union legislation, or with regard to the convergence of supervisory practices; to expand the lists of exposure classes for the purposes of the Standardised Approach or the IRB Approach to take account of developments on financial markets; to adjust certain amounts relevant to those exposure classes to take into account the effects of inflation; to adjust the list and classification of off-balance sheet items; and to adjust specific provisions and technical criteria on the treatment of counterparty credit risk, the organisation and treatment of risk, the Standardised Approach and the IRB Approach, credit risk mitigation, securitisation, operational risk, review and evaluation by the competent authorities and disclosure in order to take account of developments on financial markets or in accounting standards or Union legislation, or with regard to the convergence of supervisory practices.

It concludes that a number of proposals should be made in order to address the identified issues, better reflect the developments in retail financial markets and align the Regulation with the recently adopted Payment Services Directive (2007/64/EC).

At the Washington Summit of 15 November 2008, the leaders of the G-20 approved an action plan to reform global financial markets following five common principles: (i) strengthening transparency and accountability of financial markets and align incentives in order to avoid excessive risk-taking; (ii) strengthen regulatory regimes, prudential oversight, and risk management, and ensure that all financial markets, products and participants are regulated or subject to oversight, as appropriate to their circumstances; (iii) promote the integrity of financial markets by bolstering investor and consumer protection, avoiding conflicts of interest, preventing illegal market manipulation, fraudulent activities and abuse, and protecting against illicit finance risks arising from non-cooperative jurisdictions; (iv) reinforce global cooperation on regulation, crisis prevention, management and resolution, and (v) reforming the International Financial Institutions (i.e., the Bretton Woods Institutions) in order to increase their legitimacy and effectiveness.

The resolutions to be adopted today send a clear signal of those directions in which Parliament expects action from the Commission. I shall mention some of the most important work priorities: a single digital market and a unified intellectual property space, professional mobility for European citizens, encouragement of cross-border public procurement and services, and alignment of tax systems.
