Where the overall loss recorded for a particular marketing year under Article 15(1) and (2) is not fully covered by the proceeds from the production levies for that marketing year after application of Article 15(3), (4) and (5), an additional levy shall be charged to manufacturers, without prejudice to Article 4, to cover the outstanding balance of the overall loss.

Lorsque pour une campagne de commercialisation, la perte globale constatée en application de l'article 15, paragraphes 1 et 2, n'est pas entièrement couverte par les recettes des cotisations à la production au titre de cette même campagne après application de l'article 15, paragraphes 3, 4 et 5, une cotisation complémentaire est perçue des fabricants, sans préjudice de l'article 4, pour couvrir intégralement la partie de la perte globale en cause non couverte par lesdites recettes.

That coefficient shall be the ratio for the entire Community, reduced by 1, between the overall loss recorded under Article 15(1) and (2) for the marketing year concerned and the proceeds from the basic production levies and B levies due from manufacturers of sugar, isoglucose and insulin syrup, respectively, for that marketing year.

5. Where the figures recorded under paragraph 1 suggest that the foreseeable overall loss for the current marketing year is unlikely to be covered by the expected proceeds from the levies because of the ceilings on the basic production levy and the B levy fixed in paragraphs 3 and 4, then the maximum percentage referred to in the first indent of paragraph 4 shall be adjusted to the extent necessary to cover the overall loss, without exceeding 37,5 %.
5. (14) In the interests of equal treatment, the additional levy should be calculated for each undertaking on the basis of its share in the revenue generated by the production levies which it has paid for the marketing year in question.
(14) La cotisation complémentaire doit être établie, notamment dans un souci d'égalité de traitement, pour chaque entreprise compte tenu de sa participation aux recettes dégagées par les cotisations à la production qu'elle aura acquittées au titre de la campagne de commercialisation en cause.

Hitherto it has been possible to adjust this aid for any given marketing year in line with the storage levy set for that year and/or any change in the refining margin resulting from the prices set for the marketing year in question. In the light of experience, this aid should continue. Given the direct impact on the refining margin of changes in the storage levy, it should be made compulsory for the adjustment aid to be altered in line with that levy in the case of refining of raw sugar covered by Community price guarantees or imported from the ACP states as preferential sugar.

Such a levy shall be compulsory when the cif price of white or raw sugar is higher than the intervention price plus an amount equal to the sum of 10 % of the intervention price and the storage levy applicable during the marketing year concerned.
Ce prélèvement doit être appliqué lorsque le prix caf du sucre blanc ou du sucre brut est supérieur au prix d'intervention majoré d'un montant égal à la somme de 10% du prix d'intervention et de la cotisation de stockage applicable au cours de la campagne de commercialisation en cause.

The adjustment aid and the additional aid may be adjusted for a particular marketing year in the light of the storage levy fixed for that year, any previous adjustments and, where appropriate , economic trends in the sugar sector, particularly manufacturing and refining margins.
L'aide d'adaptation, ainsi que l'aide complémentaire peuvent être ajustées, pour une campagne de commercialisation déterminée , compte tenu du montant de la cotisation de stockage fixé pour celle-ci, des ajustements précédents, et, éventuellement , de l'évolution économique dans le secteur du sucre, notamment en ce qui concerne les marges de fabrication et de raffinage.
