This Regulation lays down rules concerning the application of financial penalties to the holders of marketing authorisations, granted under Regulation (EC) No 726/2004, in respect of infringements of the following obligations, in cases where the infringement concerned may have significant public health implications in the Community, or where it has a Community dimension by taking place or having its effects in more than one Member State, or where interests of the Community are involved:
Le présent règlement fixe des règles pour l’application de sanctions financières aux titulaires d’autorisations de mise sur le marché octroyées en vertu du règlement (CE) no 726/2004 en ce qui concerne les infractions aux obligations suivantes, lorsque l'infraction concernée peut avoir d'importantes conséquences pour la santé publique au niveau de la Communauté, lorsqu’elle revêt une dimension communautaire parce qu’elle a lieu ou déploie ses effets dans plus d’un État membre, ou lorsque les intérêts communautaires sont en jeu:

Articles 34 TFEU and 36 TFEU must be interpreted as precluding national legislation under which a parallel import authorisation may not be granted for a plant protection product which does not have, in the exporting Member State, a marketing authorisation granted in accordance with Council Directive 91/414/EEC of 15 July 1991 concerning the placing of plant protection products on the market, even though that product has a parallel import authorisation and may be regarded as identical to a product covered by a marketing authorisation granted in accordance with that directive in the importing Member State.
Les articles 34 TFUE et 36 TFUE doivent être interprétés en ce sens qu’ils s’opposent à une réglementation nationale qui exclut la délivrance d’une autorisation d’importation parallèle pour un produit phytopharmaceutique qui ne bénéficie pas, dans l’État membre d’exportation, d’une autorisation de mise sur le marché délivrée sur le fondement de la directive 91/414/CEE du Conseil, du 15 juillet 1991, concernant la mise sur le marché des produits phytopharmaceutiques, alors que ce produit bénéficie d’une autorisation d’importation parallèle et peut être considéré comme identique à un produit bénéficiant d’une autorisation de mise sur le marché délivrée conformément à cette directive dans l’État membre d’importation.

Infringements of obligations laid down in connection with marketing authorisations granted in accordance with Regulation (EC) No 726/2004 which may lead to the application of a financial penalty should concern the content of a marketing authorisation and post-marketing requirements linked to a marketing authorisation, including the requirements of Community law relating to pharmacovigilance and market surveillance.

(8) experience in the United States of America and Japan shows that the strongest incentive for industry to invest in the development and marketing of orphan medicinal products is where there is a prospect of obtaining market exclusivity for a certain number of years during which part of the investment might be recovered; data protection under Article 4(8)(a)(iii) of Council Directive 65/65/EEC of 26 January 1965 on the approximation of provisions laid down by law, regulation or administrative action relating to medicinal products(4) is not a sufficient incentive for that purpose; Member States acting independently cannot introduce such a measure without a Community dimension as such a provision would be contradictory to Directive 65/65/EEC; if such measures were adopted in an uncoordinated manner by the Member States, this would create obstacles to intra-Community trade, leading to distortions of competition and running counter to the single market; market exclusivity should however be limited to the therapeutic indication for which orphan medicinal product designation has been obtained, without prejudice to existing intellectual property rights; in the interest of patients, the market exclusivity granted to an orphan medicinal product should not prevent the marketing of a similar medicinal product which could be of significant benefit to those affected by the condition;
(8) d'après l'expérience acquise aux États-Unis d'Amérique et au Japon, la mesure d'incitation la plus efficace pour amener l'industrie pharmaceutique à investir dans le développement et la commercialisation de médicaments orphelins est la perspective d'obtenir une exclusivité commerciale pendant un certain nombre d'années au cours desquelles une partie de l'investissement pourrait être récupérée; de ce point de vue, les dispositions relatives à la protection des données prévues à l'article 4, paragraphe 8, point a) iii), de la directive 65/65/CEE du Conseil du 26 janvier 1965 concernant le rapprochement des dispositions législatives, réglementaires et administratives relatives aux médicaments(4) ne sont pas suffisamment incitatives; les États membres agissant séparément ne peuvent arrêter cette mesure sans lui conférer une dimension communautaire, car une telle disposition serait contraire à la directive 65/65/CEE; l'adoption de telles mesures en ordre dispersé par les États membres créerait des entraves au commerce intracommunautaire, lesquelles entraîneraient des distorsions de concurrence et contrecarreraient le marché unique; il convient cependant de limiter l'exclusivité commerciale à l'indication thérapeutique pour laquelle la désignation de médicament orphelin a été obtenue, sans porter atteinte aux droits de propriété intellectuelle existants, et, dans l'intérêt des patients, il importe que l'exclusivité commerciale accordée à un médicament orphelin n'empêche pas la mise sur le marché d'un médicament similaire pouvant procurer un bénéfice notable aux personnes soufrant de telles affections;

2. Notwithstanding paragraph 1, where the authorization to place the product on the market is granted before the basic patent is granted, the application for a certificate shall be lodged within six months of the date on which the patent is granted.
