It emphasises the need for EU countries to cooperate with their neighbours in the marine regions (North-East Atlantic, Baltic, Mediterranean and Black Sea), namely when devising and implementing their marine strategies.

The Union has acceded to the following instruments, establishing regional organisations, whose activities are also covered by the Agency’s objectives: the Convention on the Protection of the Marine Environment of the Baltic Sea Area (Helsinki Convention as revised in 1992) ; the Convention for the Protection of the Mediterranean Sea against Pollution (Barcelona Convention) , and its 1995 revision and to a number of protocols thereto; the Agreement for cooperation in dealing with pollution of the North Sea by oil and other harmful substances (Bonn Agreement) ; the Convention for the protection of the marine environment of the North-East Atlantic (OSPAR Convention) ; the Cooperation Agreement for the protection of the coasts and waters of the north-east Atlantic against pollution, signed on 17 October 1990 (Lisbon Agreement) , with the Additional Protocol thereto, signed on 20 May 2008, which have not yet entered into force .

The Commission used information derived from available data published by ICCAT, WCPFC, IOTC, IATTC, the North East Atlantic Fisheries Commission (NEAFC) and the South East Atlantic Fisheries Organisation (SEAFO) either in the form of Compliance Reports or in the form of IUU vessel lists as well as publicly available information retrieved from the United States Department of Commerce Report to Congress Pursuant to Section 403(a) of the Magnuson-Stevens Fisheries Conservation and Management Reauthorisation Act of 2006, January 2011 (the National Marine Fisheries Service (NMFS) report).

This Directive should contribute to the fulfilment of the obligations and important commitments of the Community and the Member States under several relevant international agreements relating to the protection of the marine environment from pollution: the Convention on the Protection of the Marine Environment of the Baltic Sea Area, approved by Council Decision 94/157/EC , the Convention for the Protection of the Marine Environment of the North-East Atlantic, approved by Council Decision 98/249/EC , including its new Annex V on the Protection and Conservation of the Ecosystems and Biological Diversity of the Maritime Area and the corresponding Appendix 3, approved by Council Decision 2000/340/EC , the Convention for the Protection of the Marine Environment and the Coastal Region of the Mediterranean, approved by Council Decision 77/585/EEC , and its amendments from 1995, approved by Council Decision 1999/802/EC , as well as its Protocol for the Protection of the Mediterranean Sea Against Pollution from Land-Based Sources, approved by Council Decision 83/101/EEC , and its amendments from 1996, approved by Council Decision 1999/801/EC .

Complying with OSPAR: The Convention for the Protection of the Marine Environment of the North East Atlantic [8] aims to prevent and eliminate pollution and to protect the maritime area of the North East Atlantic against the harmful effects of human activities (land-based sources, off-shore sources, dumping and incineration of wastes).

In the Paris Convention for the protection of the marine environment of the north-east Atlantic (September 1992), the precautionary principle is defined as the principle "by virtue of which preventive measures are to be taken when there are reasonable grounds for concern that substances or energy introduced, directly or indirectly, into the marine environment may bring about hazards to human health, harm living resources and marine ecosystems, damage amenities or interfere with other legitimate uses of the sea, even when there is no conclusive evidence of a causal relationship between the inputs and the effects".
Dans la convention de Paris pour la protection du milieu marin pour l'Atlantique du nord-est (septembre 1992) le principe de précaution est ainsi qualifié : « principe selon lequel les mesures de prévention doivent être prises lorsqu'il y a des motifs raisonnables de s'inquiéter du fait des substances ou de l'énergie introduites directement ou indirectement dans le milieu, qu'elles puissent entraîner des risques pour la santé de l'homme, nuire aux ressources biologiques ou aux écosystèmes, porter atteinte aux valeurs d'agrément ou entraver d'autres utilisations du milieu, même s'il n'y a pas de preuves concluantes d'un rapport de causalité entre les apports et les effets ».
