In the Council meeting of 30th September 2002, the Council and the Commission agreed that detailed implementing provisions concerning research activities involving the use of human embryos and human embryonic stem cells which may be funded under the FP6 have to be established by 31 December 2003.Furthermore, in that occasion, the Commission stated that, during that period and pending the establishment of detailed implementation provisions, it will not propose to fund such, with the exception of banked or isolated human embryonic stem cells in culture.
Lors de la réunion du Conseil du 30 septembre 2002, le Conseil et la Commission sont convenus qu'il faut définir, pour le 31 décembre 2003, des dispositions de mise en oeuvre détaillées concernant les activités de recherche impliquant l'utilisation d'embryons humains et de cellules souches d'embryons humains qui peuvent être financées au titre du sixième programme-cadre. En outre, à cette occasion, la Commission a déclaré que, pendant cette période et en attendant que des dispositions de mise en oeuvre détaillées soient établies, elle ne proposera pas de financer de telles activités, sauf dans le cas des cellules souches d'embryons humains en culture qui sont mises en banque ou isolées.

To ensure consistency in areas of its competence where the life of the human embryo is at stake, the EU should establish a ban and end the financing of activities which presuppose the destruction of human embryos, in particular in the areas of research, development aid and public health".

Article 19(3) of the Horizon 2020 Regulation states that "the following fields of research shall not be financed: research activity aiming at human cloning for reproductive purposes; research activity intended to modify the genetic heritage of human beings which could make such changes heritable; research activities intended to create human embryos solely for the purpose of research or for the purpose of stem cell procurement, including by means of somatic cell nuclear transfer".

Next, the Court examines whether the concept of ‘uses of human embryos for industrial or commercial purposes’, not patentable, also covers the use of human embryos for purposes of scientific research. Thus, with regard to the latter use, the Court notes that the grant of a patent for an invention implies, in principle, its industrial or commercial application.
La Cour examine ensuite la question de savoir si l’exclusion de la brevetabilité portant sur la notion d'« utilisations d’embryons humains à des fins industrielles et commerciales » couvre également l’utilisation à des fins de recherche scientifique. Ainsi, concernant cette dernière utilisation, la Cour observe que l’octroi d’un brevet à une invention implique, en principe, son exploitation industrielle et commerciale.

In conclusion, the Court holds that an invention is excluded from patentability where the implementation of the process requires either the prior destruction of human embryos or their prior use as base material, even if, in the patent application, the description of that process, as in the present case, does not refer to the use of human embryos.
En conclusion, la Cour estime qu’une invention ne peut être brevetable lorsque la mise en œuvre du procédé requiert, au préalable, soit la destruction d’embryons humains, soit leur utilisation comme matériau de départ, même si, lors de la demande de brevet, la description de ce procédé, comme en l’espèce, ne fait pas référence à l’utilisation d’embryons humains.

Nevertheless, the Court points out that the patentability of uses of human embryos for industrial or commercial purposes is not prohibited under the Directive where it concerns the use for therapeutic or diagnostic purposes which are applied to the human embryo and which are useful to it – for example to correct a malformation and improve the chances of life.

(13) Since the measures for the implementation of this decision are essentially management measures, and should therefore be adopted by the management procedure provided for in Article 4 of Council Decision 1999/468/EC of 28 June 1999, laying down the procedures for the exercise of implementing powers conferred on the Commission(8); since on the other hand research involving the use of human embryos and human embryonic stem cells is subject to ethical parameters to be established in accordance with the evolution of scientific knowledge, the opinion of the European Group on Ethics, and, where appropriate, national and international ethical legislation and rules; and, therefore, measures for the financing of such projects should be adopted by the regulatory procedure provided for in Article 5 of Council Decision 1999/468/EC.
(13) Les mesures nécessaires à la mise en oeuvre de la présente décision étant essentiellement des mesures de gestion, il convient donc que ces mesures soient arrêtées selon la procédure de gestion prévue à l'article 4 de la décision 1999/468/CE du Conseil du 28 juin 1999 fixant les modalités de l'exercice des compétences d'exécution conférées à la Commission(8); étant donné en revanche que les activités de recherche impliquant l'utilisation d'embryons humains et de cellules souches d'embryons humains sont soumises à des paramètres éthiques à établir en fonction de l'évolution des connaissances scientifiques, de l'avis du Groupe européen d'éthique et, le cas échéant, de la législation et des règles nationales et internationales en matière d'éthique, il convient dès lors que les mesures relatives au financement de tels projets soient arrêtées selon la procédure de réglementation prévue à l'article 5 de la décision 1999/468/CE du Conseil.

Article 6(2) lays down that processes for cloning human beings, processes for modifying the germ line genetic identity of human beings and uses of human embryos for industrial or commercial purposes are excluded from patentability.
En effet, l'article 6, paragraphe 2 prévoit que les procédés de clonage des êtres humains, les procédés de modification de l'identité germinale de l'être humain et les utilisations d'embryons à des fins industrielles ou commerciales sont exclus de la brevetabilité.
