With regard to the claims for the Tribunal, first, to order the applicant’s post to be regraded to a grade corresponding to the level of his responsibilities and, secondly, to order the EEAS to bear all the consequences, in particular the financial consequences, of that regrading, retrospectively from the time of his entry into the service, it should be noted that, in the context of an action brought under Article 91 of the Staff Regulations, the court may not, without encroaching upon the powers of the administration, make declarations or findings of principle, or issue directions to an institution (see order in Caminiti v Commission, F‑71/09, EU:F:2011:53, paragraph 23 and the case-law cited therein).

Since this Regulation provides that the Directives making up the 2002 regulatory framework for electronic communications are without prejudice to any specific measure adopted for the regulation of Community-wide roaming charges for mobile voice telephony calls, and since providers of Community-wide roaming services may be required by this Regulation to make changes to their retail roaming tariffs in order to comply with the requirements of this Regulation, such changes should not trigger for mobile customers any right under national laws transposing the 2002 regulatory framework for electronic communications to withdraw from their contracts.

This Regulation is without prejudice to checks carried out under general police powers and security checks on persons identical to those carried out for domestic flights, to the possibilities for Member States to carry out exceptional checks on baggage in accordance with Council Regulation (EEC) No 3925/91 of 19 December 1991 concerning the elimination of controls and formalities applicable to the cabin and hold baggage of persons taking an intra-Community flight and the baggage of persons making an intra-Community sea crossing (5), and to national law on carrying travel or identity documents or to the requirement that persons notify the authorities of their presence on the territory of the Member State in question.

Par requête déposée le 26 mai 2004 au greffe du Tribunal, la partie requérante a, en invoquant l’article 232 CE, introduit le présent recours en carence contre la Commission. Elle a conclu à ce que le Tribunal constate que la Commission est tenue d’adopter à l’égard des États membres une réglementation autorisant et rendant possible le transfert transfrontalier du siège statutaire des sociétés de capitaux et de personnes sans que les ordres juridiques des États membres puissent rendre plus difficile ou impossible un tel transfert et, en particulier, de convertir en directive la « proposition d’une quatorzième directive du Parlement européen et du Conseil sur le transfert transfrontalier du siège statutaire des sociétés, avec changement du droit qui leur est applicable ».

It is sufficient to state in this connection that such an argument is ineffective, since, as is apparent from paragraphs 31 to 38 of this judgment, the Court of First Instance correctly applied Article 7(1)(b) of Regulation No 40/94 and stated, without making any error of law, that the trade marks for which registration was applied were devoid of any distinctive character.
À cet égard, il suffit de relever qu’un tel argument est inopérant, le Tribunal ayant, ainsi qu’il ressort des points 31 à 38 du présent arrêt, appliqué correctement l’article 7, paragraphe 1, sous b), du règlement n° 40/94 et constaté, sans commettre aucune erreur de droit, l’absence de caractère distinctif des marques dont l’enregistrement est demandé.
