Until 31 March 2017, when an act is to be adopted by the Council acting by qualified majority, a member of the Council may request that it be adopted in accordance with the qualified majority as defined in Article 3(3) of Protocol No 36 on transitional provisions, annexed to the Treaty on European Union, to the Treaty on the Functioning of the European Union and to the Treaty establishing the European Atomic Energy Community.

Parliament shall decide on the act requiring its consent under the Treaty on European Union or the Treaty on the Functioning of the European Union by means of a single vote on consent, irrespective of whether the recommendation from the committee responsible is to approve or reject the act, and no amendments may be tabled. The majority required for the adoption of the consent shall be the majority indicated in the article of the Treaty on European Union or the Treaty on the Functioning of the European Union that constitutes the legal basis for the proposed act or, where no majority is indicated therein, the majority of the votes cast.

Where a decision is to be adopted by the Council acting by qualified majority, 65 % of the population of the Union or, where not all Member States participate in voting, of the population of the participating Member States, and the minimum number of Council members representing more than 35 % of the population of the participating Member States shall be calculated in accordance with the population figures set out in Annex III. These figures shall also apply between 1 November 2014 and 31 March 2017 where, in accordance with Article 3(2) of Protocol No 36 on transitional measures, annexed to the Treaty on European Union, to the Treaty on the Functioning of the European Union and to the Treaty establishing the European Atomic Energy Community, a member of the Council requests that an act be adopted in accordance with the qualified majority as defined in paragraph 3 of that Article and a member of the Council requests that it be verified that the Member States comprising the qualified majority represent at least 62 % of the total population of the Union’.

Where, following a decision to suspend voting rights adopted pursuant to paragraph 3 of Article 7 of the Treaty on European Union, the Council acts by a qualified majority on the basis of a provision of the Treaties, that qualified majority shall be defined in accordance with Article 238(3)(b) of this Treaty, or, where the Council acts on a proposal from the Commission or from the High Representative of the Union for Foreign Affairs and Security Policy, in accordance with Article 238(3)(a).

If the European Parliament, by an absolute majority of its members, or the Council, by the majority provided for by Article 205(2) of the Treaty, express any objections to the final draft of the executive measures presented by the Commission within one month, which may be extended by another month, of its being forwarded, the Commission must either withdraw its draft and present a proposal for an instrument in accordance with the procedure in Article 251 of the EC Treaty, or adopt the proposed measure, possibly amending its draft to take account of the objections.

The European Constitutional Treaty, often called the Constitution, aimed to repeal and replace with a single text all the existing treaties with the exception of the Euratom Treaty. This text consolidated 50 years of European treaties. Apart from this work of consolidation and simplification of the texts, the Constitution also introduced numerous innovations such as: attribution of legal personality to the Union, clear definition of powers, the possibility of a Member State's withdrawing from the Union, the incorporation of the Charter of Fundamental Rights, simplification of the Union's instruments of action, creation of the European Foreign Minister, the formal institutionalisation of the European Council, which will be chaired by an elected president for a period of two and a half years, the definition of a new system of qualified majority voting at the Council, various policy modifications, the disappearance of the pillar structure, the extension of qualified majority voting at the Council and the ordinary legislative procedure (codecision).
