Secondly, the scheme in question constitutes discrimination in breech of Articles 52 and 6 of the Treaty where it is a condition for certain beneficiaries that they were resident in the new Länder on 3 October 1990, something that in practice was only possible for German nationals (of the new Länder).

At this stage of the investigation, the Commission cannot rule out the possibility that the measure in question may constitute a discrimination, in infringement of the Treaty, in view of the fact that some of the beneficiaries are required to have been resident in the new Länder on 3 October 1990 - in practice only possible for German nationals (from the new Länder).
