The European Commission requested Luxembourg, Poland and Portugal today to comply with judgements of the Court of Justice of the EU related to the good functioning of the internal market for road transport.In 3 judgements from 2016[†], the Court found these Member States to be in breach of EU law (Regulation (EC) No 1071/2009) for not having established national electronic registers of road undertakings and for not having interconnected those with the registers of the other Member States.National electronic registers of road undertaking are database which contain some information (such as the name, address and number of vehicles) on all companies that have been authorised to perform commercial operations by a Member State.
La Commission européenne a demandé aujourd'hui au Luxembourg, à la Pologne et au Portugal de se conformer à des arrêts de la Cour de la justice de l'UE relatifs au bon fonctionnement du marché intérieur dans le domaine du transport routier.Dans trois arrêts rendus en 2016[†], la Cour a jugé que ces États membres enfreignaient le droit de l'UE [et plus précisément le règlement (CE) nº 1071/2009] parce qu'ils n'avaient pas établi leur registre électronique national des entreprises de transport routier et qu'ils n'avaient pas interconnecté celui-ci avec les registres des autres États membres.Les registres électroniques nationaux des entreprises de transport routier sont des bases de données qui contiennent certaines informations (nom, adresse ou encore nombre de véhicules) relatives à toutes les sociétés qui ont été autorisées à exercer des activités de transport commercial par un État membre.

2. The provisions of paragraph 1 shall apply to the references for a preliminary ruling provided for in the Protocol concerning the interpretation by the Court of Justice of the Convention of 29 February 1968 on the mutual recognition of companies and legal persons and the Protocol concerning the interpretation by the Court of Justice of the Convention of 27 September 1968 on jurisdiction and the enforcement of judgments in civil and commercial matters, signed at Luxembourg on 3 June 1971, and to the references provided for by Article 4 of the latter Protocol.

This Convention shall not prejudice the application by the Member States of the European Community of the Council Regulation (EC) No 44/2001 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters, as well as any amendments thereof, of the Convention on Jurisdiction and the Enforcement of Judgments in Civil and Commercial Matters, signed at Brussels on 27 September 1968, and of the Protocol on interpretation of that Convention by the Court of Justice of the European Communities, signed at Luxembourg on 3 June 1971, as amended by the Conventions of Accession to the said Convention and the said Protocol by the States acceding to the European Communities, as well as of the Agreement between the European Community and the Kingdom of Denmark on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters, signed at Brussels on 19 October 2005.

La présente convention ne préjuge pas l'application par les États membres de la Communauté européenne du règlement (CE) no 44/2001 du Conseil concernant la compétence judiciaire, la reconnaissance et l'exécution des décisions en matière civile et commerciale, et de toute modification apportée à celui-ci, de la convention concernant la compétence judiciaire et l'exécution des décisions en matière civile et commerciale, signée à Bruxelles le 27 septembre 1968, et du protocole concernant l'interprétation de cette convention par la Cour de justice des Communautés européennes, signé à Luxembourg le 3 juin 1971, tels qu'ils ont été modifiés par les conventions d'adhésion à ladite convention et audit protocole par les États adhérant aux Communautés européennes, ainsi que de l'accord entre la Communauté européenne et le Royaume de Danemark sur la compétence judiciaire, la reconnaissance et l'exécution des décisions en matière civile et commerciale, signé à Bruxelles le 19 octobre 2005.

7. Insofar as the relations between the Member States of the European Community and the non-European territories referred to in Article 70(1)(b) are concerned, this Convention shall replace the Convention on Jurisdiction and the Enforcement of Judgments in Civil and Commercial Matters, signed at Brussels on 27 September 1968, and of the Protocol on interpretation of that Convention by the Court of Justice of the European Communities, signed at Luxembourg on 3 June 1971, as amended by the Conventions of Accession to the said Convention and the said Protocol by the States acceding to the European Communities, as of the date of the entry into force of this Convention with respect to these territories in accordance with Article 73(2).
7. Dans la mesure où les relations entre les États membres de la Communauté européenne et les territoires non européens visés à l'article 70, paragraphe 1, point b), sont concernées, la présente convention remplace la convention concernant la compétence judiciaire et l'exécution des décisions en matière civile et commerciale, signée à Bruxelles le 27 septembre 1968, et le protocole concernant l'interprétation de cette convention par la Cour de justice des Communautés européennes, signé à Luxembourg le 3 juin 1971, tels qu'ils ont été modifiés par les conventions d'adhésion à ladite convention et audit protocole par les États adhérant aux Communautés européennes, à la date de l'entrée en vigueur de la présente convention à l'égard de ces territoires conformément à l'article 73, paragraphe 2.

Notes that the Institution's appeal against the judgement, dated 3 April 1998, whereby the Luxembourg Commercial Court found as inadmissible the case brought on 22 March 1995 by the European Parliament against Royale Belge S.A., with which Parliament took out, on 30 June 1976, the insurance policy referred to in Article 75 of the Financial Regulation, is still pending;

The Hellenic Republic hereby accedes to the Convention on jurisdiction and enforcement of judgments in civil and commercial matters, signed at Brussels on 27 September 1968 (hereinafter called "the 1968 Convention"), and to the Protocol on its interpretation by the Court of Justice, signed at Luxembourg on 3 June 1971 (hereinafter called "the 1971 Protocol"), with the adjustments made to them by the Convention on the accession of the Kingdom of Denmark, of Ireland and of the United Kingdom of Great Britain and Northern Ireland to the Convention on jurisdiction and enforcement of judgments in civil and commercial matters and to the Protocol on its interpretation by the Court of Justice, signed at Luxembourg on 9 October 1978 (hereinafter called "the 1978 Convention").
