In a note dated 28 July 2009, entitled ‘Complaint’, the applicant made reference to Article 90(2) of the Staff Regulations, acknowledged receipt of the letter of 23 July 2009 and stated that she had asked, without success, for a copy of her written tests (b) and (c) and of the personal evaluation sheets showing how the selection board had marked those tests; she then reiterated those requests, adding that she wished to receive any additional information concerning her in connection with her participation in the competition.

The recognition and execution of a decision rendered following a trial at which the person concerned did not appear in person should not be refused if either he or she was summoned in person and thereby informed of the scheduled date and place of the trial which resulted in the decision, or if he or she actually received, by other means, official information of the scheduled date and place of that trial in such a manner that it was unequivocally established that he or she was aware of the scheduled trial.
La reconnaissance et l’exécution d’une décision rendue à l’issue d’un procès auquel la personne concernée n’a pas comparu en personne ne devraient pas être refusées si l’intéressé a été cité à personne et a ainsi été informé de la date et du lieu fixés pour le procès qui a mené à la décision, ou s’il a été informé officiellement et effectivement par d’autres moyens de la date et du lieu fixés pour ce procès, de telle sorte qu’il a été établi de manière non équivoque que l’intéressé a eu connaissance du procès prévu.

2. If, for one of the reasons listed in paragraph 1 or for any other reason, a member of a Board of Appeal considers that he/she should not take part in any appeal proceeding, he/she shall inform the Board of Appeal accordingly.

6. That Member State shall also provide the data subject with information explaining the steps which he/she can take if he/she does not accept the explanation provided. This shall include information on how to bring an action or, if appropriate, a complaint before the competent authorities or courts of that Member State and any financial or other assistance that is available in accordance with the laws, regulations and procedures of that Member State.

125 (4) It is worth adding that, to avoid placing excessive restrictions on the free movement of professionals, the entitlement of the host Member State to draw up a list of approved medical practitioners should, in any event, be accompanied by two obligations: first, it must justify the specific health requirements making such a network of approved practitioners necessary, and it must secondly inform the migrant of the various means by which he/she can meet these requirements (approved medical practitioner in the Member State of origin, attestation from the authorities of the Member State of origin or, failing these, approved medical practitioner in the host Member State).
125 (4) On peut ajouter que, afin de ne pas entraver de manière excessive la libre circulation des professionnels, la possibilité qui serait offerte à l'État membre d'accueil d'établir une liste de médecins agréés devrait, en tout état de cause, s'accompagner de deux obligations à sa charge: d'une part, justifier les exigences particulières de santé qui conduisent à la mise en place d'un tel réseau de médecins agréés et, d'autre part, informer le migrant sur les différentes possibilités qui s'offrent à lui pour satisfaire ces exigences (médecin agréé de l'État d'origine, attestation des autorités de l'État d'origine ou, à défaut, médecin agréé par l'État d'accueil).
