Consortia aim to enable cooperation in the joint operation of a maritime transport service and improve the service that each member would offer individually without the consortium, in order for international liner shipping companies to rationalise their operations.

1) In the preamble, after recital 4, the texts of the fourth, fifth and sixth recitals of Regulation (EEC) No 479/92 should be reinstated in the modified form of the following two recitals: ‘(5) Joint service agreements between liner shipping companies with the aim of rationalising their operations by means of technical, operational and/or commercial arrangements (described in shipping circles as consortia) can help to provide the necessary means for improving the productivity of liner shipping services and promoting technical and economic progress, (6) Maritime transport is important for the development of the Community’s trade and consortia agreements can fulfil a role in this respect, taking account of the special features of international liner shipping.

In light of the global nature of the liner shipping industry, the Commission should take the appropriate steps to advance the removal of the price fixing exemption for liner conferences that exist elsewhere whilst maintaining the exemption for operational cooperation between shipping lines grouped in consortia and alliances, in line with the recommendations of the OECD Secretariat in 2002.
En considération du caractère global des transports maritimes de lignes, la Commission devrait prendre les mesures appropriées pour faciliter le retrait par d'autres instances des exemptions dont bénéficient actuellement les conférences maritimes en matière de fixation de prix, tout en maintenant l'exemption existant en matière de coopération technique entre compagnies de lignes regroupées au sein de consortiums et d'alliances, conformément aux recommandations formulées par le secrétariat de l'OCDE en 2002.

Liner conference' means a group of two or more vessel-operating carriers which provides international liner services for the carriage of cargo on a particular route or routes within specified geographical limits and which has an agreement or arrangement, whatever its nature, within the framework of which they operate under uniform or common freight rates and any other agreed conditions with respect to the provision of liner services.
