(80)The Commission should be empowered to adopt delegated acts in accordance with Article 290 of the Treaty on the Functioning of the European Unionin order to: specifythe definitions of "critical functions" and "core business lines", specify the circumstances when an institution is failing or likely to fail specify the circumstances when the asset separation tool should be applied specify the liabilities excluded from the scope of application of the bail-in tool, specify the circumstances when exclusion from the bail-in tool is necessary to ensure the continuation of critical operations and core business lines, specify the criteria for the determination of the minimum amount of eligible liabilities required from institutions for the purposes of the bail in tool, specify the circumstances when, in application of the bail-in tool, existing shares should be cancelled and liabilities should be converted into shares, specify the circumstances when third country resolution proceedings should not be recognised, further specify the conditions under which it should be considered that the target level of the financing arrangements has significantly deviated from the initial level, adopt criteria aimed at adjusting the contributions to the financing arrangements to the risk profile of institutions, define obligations aimed at ensuring the effective payment of the contributions to the financing arrangements and specify the conditions for the mutual borrowing between national financing arrangements.

Under Directive 92/44/EEC, Member States must ensure that the telecommunications organizations make available certain types of leased lines to all providers of telecommunications services. However, the Directive provides only for such offer of a harmonized set of leased lines up to a certain bandwidth. Companies needing a higher bandwidth to provide services based on new high-speed technologies such as SDH (synchronous digital hierarchy) have complained that the telecommunications organizations concerned are unable to meet their demand whilst it could be met by the optic fibre networks of other potential providers of telecommunications infrastructure, in the absence of the current exclusive rights. Consequently, the maintenance of these rights delays the emergence of new advanced telecommunications services and therefore restricts technical progress at the expense of the users contrary to Article 90 (1) of the Treaty, in conjunction with point (b) of the second paragraph of Article 86 of the Treaty.

(20) As regards the cost structure of voice telephony, a distinction must be made between the initial connection, the monthly rental, local calls, regional calls and long distance calls. The tariff structure of voice telephony provided by the telecommunications organizations in certain Member States is currently still out of line with cost. Certain categories of calls are provided at a loss and are cross-subsidized out of the profits from other categories. Artificially low prices, however, impede competition since potential competitors have no incentive to enter into the relevant segment of the voice telephony market and are contrary to Article 86 of the Treaty, as long as they are not justified under Article 90 (2) of the Treaty as regards specific identified end-users or groups of end-users. Member States should phase out as rapidly as possible all unjustified restrictions on tariff rebalancing by the telecommunications organizations and in particular those preventing the adaptation of rates which are not in line with costs and increase the burden of universal service provision. Where this is justified, the proportion of net costs insufficiently covered by the tariff structure may be reapportioned among all parties concerned in a non-discriminatory and transparent manner.
(20) considérant que, en matière de structure tarifaire de la téléphonie vocale, il convient de distinguer entre la redevance initiale de connexion, l'abonnement mensuel et les tarifs locaux, nationaux et internationaux; que ces différents éléments tarifaires du service fourni par les organismes de télécommunications de certains États membres sont actuellement encore déphasés par rapport aux coûts; que certaines catégories d'appels sont fournies à perte et sont subventionnées par les profits réalisés sur d'autres catégories; que ces tarifs artificiellement bas restreignent toutefois la concurrence car les entrants potentiels n'ont aucun intérêt à s'attaquer à ce segment du marché de la téléphonie vocale; que de tels prix sont contraires à l'article 86 du traité, à moins d'être justifiés sur la base de l'article 90 paragraphe 2 en ce qui concerne certains utilisateurs finals ou certaines catégories d'utilisateurs finals; que les États membres devraient procéder, dans les meilleurs délais, à la suppression graduelle des restrictions subsistantes non justifiées au rééquilibrage des tarifs de la part des organismes de télécommunications, et en particulier celles empêchant l'adaptation des tarifs qui ne sont pas liés aux coûts et qui accroissent la charge de la fourniture du service universel; que, dans les cas justifiés, la fraction des coûts nets insuffisamment couverte par la structure tarifaire peut être redistribuée entre tous les utilisateurs de façon non discriminatoire et transparente;

(9) As regards the access of new competitors to the telecommunications markets, only mandatory requirements can justify restrictions to the fundamental freedoms provided for in the Treaty. These restrictions should be limited to what is necessary to achieve the objective of a non-economic nature pursued. Member States may therefore only introduce licensing or declaration procedures where it is indispensable to ensure compliance with the applicable essential requirements and, with regard to the provision of voice telephony and the underlying infrastructure, introduce requirements in the form of trade regulations where it is necessary in order to ensure, in accordance with Article 90 (2) of the Treaty, the performance in a competitive environment of the particular tasks of public service assigned to the relevant undertakings in the telecommunications field and/or to ensure a contribution to the financing of universal service. Other public service requirements can be included by Member States in certain categories of licences, in line with the principle of proportionality and in conformity with Articles 56 and 66 of the Treaty.
(9) considérant que, en ce qui concerne l'accès de nouveaux concurrents aux marchés de télécommunications, seules des exigences impératives peuvent justifier des restrictions aux libertés fondamentales prévues par le traité; que ces restrictions doivent être limitées à ce qui est nécessaire pour atteindre l'objectif de nature non économique poursuivi; que les États membres ne sont par conséquent habilités à instaurer des procédures d'octroi de licences ou de déclaration que quand cela est indispensable pour garantir le respect des exigences essentielles et, en ce qui concerne l'offre de téléphonie vocale et de l'infrastructure sous-jacente, à édicter des réglementations de commerce lorsque cela est nécessaire afin d'assurer, conformément à l'article 90 paragraphe 2 du traité, l'exercice de la mission particulière de service public dont l'entreprise concernée est chargée en matière de télécommunications et/ou d'assurer le financement du service universel; que, conformément aux articles 56 et 66, des obligations de service public supplémentaires peuvent être prévues par les États membres dans certaines catégories de licences dans le respect du principe de proportionnalité;
