whereas the international community has witnessed over the last few years a harrowing trend of attacks on hospitals and schools in armed conflicts around the world, such as the latest attacks on Doctors without Borders (MSF) health centres in Kunduz (Afghanistan) on 3 October 2015, in Razah (Yemen) on 10 January 2016 and in a number of Syrian towns throughout the ongoing conflict; whereas there has been an unprecedented increase in denial of humanitarian aid and access, the execution of civilians and humanitarian personnel, detention in dire conditions, and civilians being used as hostages or forced into slavery; whereas the growing needs and challenges, the lack of sustained commitments and the rising cost of humanitarian assistance have contributed to the current humanitarian system reaching its limits, and whereas this has forced a number of organisations to temporarily suspend food assistance, shelter and other life-saving humanitarian operations.

D. whereas President Nasheed’s trial presented several irregularities at all stages as he was repeatedly denied legal representation, he was denied the right to appeal, the rights of defence to call and examine witnesses was either denied or severely limited, two presiding judges of the case served as prosecution’s witnesses, the hearing was not public and the appeal process was hampered by the courts not providing necessary documentation in time; whereas similar things happened in the other cases, highlighting a sever lack of independence and impartiality in the judicial system;

Expresses concern about Kosovo’s limited framework for witness protection, which is particularly important in high-profile cases; underlines the importance of a fully functioning witness protection programme; calls on the Kosovo authorities to strengthen the effectiveness and credibility of the witness protection system, and on EULEX to increase its support for these efforts; urges the Member States to accept more cases of witness relocation and underlines the need to continue to seek ways to acknowledge the suffering and respect the right to truth and justice of all victims of war crimes, including support for the establishment of the RECOM regional truth commission;

In line with everything we have done to date, in addition to amending the issues highlighted above, we will continue to fight for the following aspects, inter alia : recognition of the specific nature of Mediterranean natural disasters; adaptation of the Solidarity Fund in terms of time limits (having witnessed unjustifiable and unacceptable delays in its mobilisation and the delivery of Community funds to victims); adaptation of the Solidarity Fund in terms of eligible actions, particularly with regard to the specific nature of various natural disasters such as drought and fire; inclusion within the eligible actions of support for re-establishing productive activity in areas affected by disasters, and also operations to provide emergency land-based and airborne equipment for fighting forest fires.

An official of a requested authority may be authorised to appear, within the limitations of authorisation granted, as an expert or witness in administrative proceedings regarding the matters covered by this Agreement in the territory of the other Contracting Party, and produce such objects, documents or certified copies thereof, as may be needed for the proceedings.
