– (DE) Mr President, even though we shall be abstaining in the vote on the replacement, we can go along with the substance of these arguments, but I would like once again to emphasise – and I hope that we agree on this – that we will be raising objections to the actions taken in Libya and shall be continuing to defend the interests of the Libyan nurses and the medical personnel as we have done in the past.
- (DE) Monsieur le Président, même si nous nous abstiendrons lors du vote sur le remplacement, nous pouvons accepter la substance de ces arguments, mais je voudrais souligner une fois encore - et j’espère que nous sommes d’accord là-dessus - que nous émettrons des objections quant aux mesures prises en Libye et que nous continuerons à défendre les intérêts des infirmières libyennes et du personnel médical, comme nous l’avons fait dans le passé.

– having regard to the Conclusions of the General Affairs and External Relations Council of 11 October 2004 expressing grave concern over the plight of the imprisoned medical personnel, its decision to provide assistance to the Libyan health services, the EU Presidency Statement of 19 December 2006 on the decision of the Criminal Court in Libya sentencing to death five Bulgarian nurses and a Palestinian doctor, Commissioner Ferrero-Waldner's statement on the Libyan Court verdict also of 19 December 2006 on the Benghazi case, and the statements by the President of the European Parliament of 30 November 2006 and 20 December 2006,

The Libyan death sentence against the Bulgarian nurses and Palestinian doctor is atrocious and deepens the tragedy of their wrongful imprisonment these past eight years.
- (EN) La condamnation à mort libyenne infligée aux infirmières bulgares et au médecin palestinien est atroce et ne fait qu’aggraver la tragédie de leur emprisonnement injuste durant ces 8 dernières années.

1. Condemns the verdict of the Libyan Criminal Court of 19 December 2006, convicting, after a re-trial, and sentencing to death five Bulgarian nurses, Kristiana Vulcheva, Nasya Nenova, Valentina Siropulo, Valya Chervenyashka and Snezhana Dimitrova, and a Palestinian doctor, Ashraf al-Haiui, who have already spent eight years in prison in connection with the 1999 HIV/AIDS case at the Benghazi hospital;
1. condamne le verdict de la Cour pénale libyenne du 19 décembre 2006, qui a reconnu coupables, au terme d'un second procès, et condamné à mort cinq infirmières bulgares - Kristiana Vulcheva, Nasya Nenova, Valentina Siropulo, Valya Chervenyashka, Snezhana Dimitrova - et un médecin palestinien, Ashraf al-Haiui, lesquels ont déjà passé huit ans en prison dans le cadre de l'affaire de VIH/sida de 1999 à l'hôpital de Benghazi;

B. whereas on 6 May 2004 the Court sentenced five Bulgarian nurses and a Palestinian doctor to death by firing squad; whereas on 25 December 2005 the Libyan Supreme Court issued its ruling on the appeal against the death sentence and ordered a new trial; whereas a new trial was held from 11 May 2006 and the death sentences were confirmed on 19 December 2006,
B. considérant que, le 6 mai 2004, la Cour a condamné cinq infirmières bulgares et un médecin palestinien au peloton d'exécution; considérant que, le 25 décembre 2005, la Cour suprême de Libye a rendu sa décision sur l'appel de la condamnation à mort et a ordonné un nouveau procès; considérant qu'un nouveau procès a eu lieu à partir du 11 mai 2006 et que les condamnations à mort ont été confirmées le 19 décembre 2006,

Following the decision today by a Libyan appeal court to clear nine policemen and a doctor accused of mistreating 5 Bulgarian nurses currently in jail in Tripoli, the European Commissioner for External Relations and Neighbourhood Policy, Benita Ferrero-Waldner said:
Madame Benita Ferrero-Waldner, commissaire européen chargé des relations extérieures et de la politique de voisinage, a fait la déclaration suivante après que la décision d’une cour d’appel libyenne a blanchi neuf policiers et un médecin accusés d’avoir maltraité cinq infirmières bulgares actuellement en prison à Tripoli.

It indicates that the Libyan Supreme Court accepts that the original trial needs additional consideration, and that the death sentence against the five Bulgarian nurses and the Palestinian medic, cannot be confirmed.
