Your rapporteur, on the other hand, takes the view that the liberalization of access to railway infrastructure should take place not all at once, but in stages; the necessary accompanying measures must also be taken, as occurred in the case of the liberalization of access to air transport , telecommunications and maritime transport.

Following the same reasoning, and in particular to ensure that public and private operators are put on an equal footing, the Commission has submitted a proposal [41] allowing, inter alia, to exempt from the scope of Directive 93/38/EEC those sectors or services to which it applies (water, energy, transport and telecommunications) which, in a given Member State, operate in conditions of effective competition, after the relevant activity has been effectively liberalized according to relevant EC legislation.
