The new administrative interpretation adopted by the Kingdom of Spain that extend the scope of application Article 12 (5) of the Real Legislative Decree 4/2004 of 5 March 2004, consolidating the amendments made to the Spanish Company Tax Act in order to cover indirect shareholding acquisitions of non-resident companies through a direct shareholding acquisition of non-resident holding companies, and which has been unlawfully put into effect by the Kingdom of Spain in breach of Article 108(3) of the Treaty, is incompatible with the internal market.
La nouvelle interprétation administrative adoptée par le Royaume d'Espagne, qui élargit le champ d'application de l'article 12, paragraphe 5, du décret législatif royal no 4/2004 du 5 mars 2004 portant approbation de la refonte de la loi sur l'impôt des sociétés, afin de couvrir les prises de participations indirectes dans des entreprises étrangères par l'intermédiaire d'une prise de participations directes dans des holdings étrangères, et exécutée de manière illégale par le Royaume d'Espagne en violation de l'article 108, paragraphe 3, du traité est incompatible avec le marché intérieur.

Declares that, by having adopted the provisions of Article 46(c) of Royal Legislative Decree 1/2002 approving the consolidated text of the Law governing pension schemes and funds (Real Decreto Legislativo 1/2002, por el que se aprueba el texto refundido de la Ley de Regulación de los Planes y Fondos de Pensiones) of 29 November 2002, and Article 86(1) of Royal Legislative Decree 6/2004 approving the consolidated text of the Law on the organisation and supervision of private insurance (Real Decreto Legislativo 6/2004, por el que se aprueba el texto refundido de la Ley de ordenación y supervisión de los seguros privados) of 29 October 2004, pursuant to which pension funds established in Member States other than the Kingdom of Spain and offering occupational pension schemes in that Member State and insurance companies operating in Spain under the freedom to provide services are required to appoint a tax representative resident in that Member State, the Kingdom of Spain has failed to fulfil its obligations under Article 56 TFEU;

Some Member States are quite advanced in terms of guidelines on technical and economic valuation (Belgium, Denmark, France, Hungary, Netherlands, Spain, and UK), procedures and manuals for risk assessment (Spain, Portugal, Italy) and legislative guidelines (Spain, Hungary, Czech Republic, Latvia and Poland).

On 3rd July 2001, as required by Community legislation, Spain informed the Commission’s Rapid Alert System for Food that it had withdrawn products from the market, in this case olive-residue oil contaminated with Polycyclic Aromatic Hydrocarbons (PAHs), such as benzo(a)pyrene.

Nonetheless, as I have indicated, in response to enquiries from the Commission, the authorities in both Ireland and Spain, and the major animal welfare organisation in Spain, have indicated that the situation has considerably improved, not least, in Spain, as a result of the introduction of legislation in the areas of the autonomous regions and also because of the greater vigilance of the police authorities in prosecuting infringements.

Apart from Ireland which legislation has not yet entered into force and Luxembourg which is drafting new legislation, Spain, Portugal and the UK have not taken the necessary measures to comply with the Articles 8 and 9 of the framework Decision.
