The Chairman: If the officer determines to lay the charge, and if it is proved beyond a reasonable doubt in court that oil did leak into the water and that it was an intentional act, notwithstanding the previous history, and the ship — I find it interesting a ship can be convicted — is convicted of that offence, then the judge has to either let him go or charge him no less than the minimum amount set out in the act.
