(4) A band is entitled to be compensated with an equal area of land or in money, or partly with land and partly in money, at the band’s option, in respect of land expropriated in full ownership for a purpose mentioned in paragraph 120(1)(a), (b), (c) or (e), and the type and amount of compensation must be approved by the electors of the band at a special band meeting or referendum at which at least twenty-five per cent of the electors voted on the matter.

(2) With respect to a lease of public lands referred to in subsection (1) that is granted for the purpose of residence and that restricts occupancy of the leased public lands to the period beginning on April 1 in any year and ending on October 31 in that year, if the leased public lands have been designated through a management plan tabled in each House of Parliament pursuant to section 11 of the Act or through guidelines established by the Minister as public lands available for occupancy during the period beginning on November 1 in any year and ending on March 31 in the following year, the Minister may, on application by the lessee, permit the occupancy of the leased public lands during part or all of the period beginning on November 1 in any year and ending on March 31 in the following year if the leased public lands are to be occupied only by eligible residents during the whole of the permitted occupancy period and their presence in the park is necessary for the continued operation of the park during the whole of that period.
(2) Dans le cas d’un bail octroyé à des fins d’habitation à l’égard de terres domaniales mentionnées au paragraphe (1), qui limite l’occupation des terres domaniales louées à la période commençant le 1 avril et se terminant le 31 octobre de la même année, le ministre peut, si ces terres sont parmi celles dont l’occupation est permise au cours de la période commençant le 1 novembre et se terminant le 31 mars suivant, selon le plan directeur déposé devant chaque chambre du Parlement en application de l’article 11 de la Loi ou selon les lignes directrices établies par le ministre, permettre, à la demande du preneur, l’occupation des terres domaniales louées durant tout ou partie de la période commençant le 1 novembre et se terminant le 31 mars suivant, si les terres domaniales louées seront occupées, durant toute la période qu’il permet, uniquement par des résidents admissibles dont la présence dans le parc est nécessaire à l’exploitation continue de celui-ci durant toute cette période.

6. On the basis of rules agreed as part of an international agreement on climate change, the Commission shall propose to include emissions and removals related to land use, land use change and forestry in the Community reduction commitment, as appropriate, according to harmonised modalities ensuring permanence and the environmental integrity of the contribution of land use, land use change and forestry as well as accurate monitoring and accounting.

2. In order to facilitate the control of landings by the port authorities and the documentation referred to in paragraph 1, masters of vessels, or their representatives, who hold a valid special fishing permit and who intend to land shark fins or remaining parts of sharks outside Community ports, shall notify the authorities of the flag State and the competent authorities of the State whose ports or landing facilities they want to use, at least 72 hours before the estimated time of arrival at the port of landing, of the catches retained on board, the catches intended for landing and their estimated time of arrival at the port.
