Did this entitle Mr Kyrian to challenge the enforcement of the claim in the Czech courts rather than the German courts, even though the text of Article 12(1) and (3) of Directive 76/308, the measure in force at the material time, and which is now reflected in Article 14 of Directive 2010/24, suggested that Mr Kyrian was bound to bring his challenge before the German courts?
