IN-CONTEXT TRANSLATIONS

– having regard to Joint Communiqué No 60 regarding the Agreement for the creation of a Special Jurisdiction for Peace, signed in Havana on 23 September 2015, and to Joint Communiqué No 64, of 15 December 2015, on the Agreement on the Victims of the Conflict, ‘Comprehensive System for Truth, Justice, Reparation and Non-Repetition’, including the Special Jurisdiction for Peace and the Commitment on Human Rights,
– vu les communiqués communs n° 60 sur l'accord de création d'une juridiction spéciale pour la paix, signé à La Havane le 23 septembre 2015, et n° 64 du 15 décembre 2015 comportant l'accord sur les victimes du conflit, intitulé "système intégral de vérité, de justice, de réparation et de non-répétition", qui comprend la juridiction spéciale pour la paix et l'engagement sur les droits de l'homme,

K. whereas the Government of Colombia, its legislative chamber and the Colombian people are sovereign in establishing the parameters of this Special Jurisdiction for Peace and that said Jurisdiction will have law courts and a Peace Tribunal, whose vital task it will be to put an end to impunity, uncover the truth and judge and punish the perpetrators of crimes committed during the conflict, in particular the most serious and representative ones, ensuring there is no repetition and contributing in addition to reparations for victims;
K. considérant que le gouvernement colombien, son assemblée législative et le peuple colombien sont souverains pour fixer les paramètres de cette juridiction spéciale pour la paix et que cette juridiction comportera des chambres et un tribunal pour la paix, dont la fonction première sera de mettre un terme à l'impunité, de parvenir à la vérité ainsi que de juger et de sanctionner les auteurs des crimes commis pendant le conflit, notamment les crimes les plus graves et les plus représentatifs, afin qu'ils ne se reproduisent plus et que les victimes obtiennent réparation;

G. whereas once the aforementioned agreements on Justice for Peace and Victims of the Conflict had been reached, the negotiators took a major and apparently irreversible step towards peace in that the two parties set a fixed period of six months from the signing of the agreement on the establishment of a Special Jurisdiction for Peace in which to achieve peace, the putative end-date being 23 March 2016;
G. considérant qu'en concluant ces accords sur la justice dite pour la paix et sur les victimes du conflit, les négociateurs ont fait un pas considérable vers la paix, qui semble irréversible du fait que les deux parties se sont donné six mois au maximum pour instaurer la paix à compter de la conclusion de l'accord sur la création d'une juridiction spéciale pour la paix, se fixant comme délai indicatif la date du 23 mars 2016;

2. Considers that both the signing of the recent agreement on the creation of a Special Jurisdiction for Peace, and the reaffirmation of the other agreements reached previously on comprehensive rural reform, on political participation and democratic openness to build peace, and on solving the problem of illicit drugs, constitute decisive steps towards achieving a final peace agreement that is endorsed by Colombian society and makes it possible to attain a stable and lasting peace that will put an end to more than half a century of internal armed conflict and take into account most notably the right of the victims of the conflict to full, true and fair reparation for the physical, moral and material damages suffered;
2. estime que la signature du récent accord sur la création d'une juridiction spéciale pour la paix ainsi que la réaffirmation des autres accords conclus précédemment sur la réforme rurale intégrale, sur la participation politique et l'ouverture démocratique pour bâtir la paix ainsi que sur la solution au problème des drogues illicites constituent des avancées décisives dans la conclusion d'un accord de paix définitif bénéficiant du soutien de la société colombienne et permettant d'instaurer une paix stable et durable qui mettra fin à plus d'un demi-siècle de conflit armé intérieur et qui tiendra notamment compte du droit des victimes du conflit à une réparation complète, véritable et juste des dommages physiques, moraux et matériels subis;

F. whereas on 23 September 2015 the Government of Colombia and the FARC announced the conclusion of an agreement on the creation of a Special Jurisdiction for Peace under international law to fulfil the rights of victims and contribute to the creation of a stable and lasting peace; whereas the parties have agreed to the implementation of a comprehensive system of truth, justice, reparation and no repetition, including the creation of a Commission for the Clarification of the Truth, Coexistence and Non-Repetition, as well as agreements on reparation to victims and the end of impunity; whereas following this agreement, both sides agreed to achieve peace by 23 March 2016 at the latest;
F. considérant que, le 23 septembre 2015, le gouvernement colombien et les FARC ont annoncé la conclusion d'un accord sur la mise en place d'une juridiction spéciale pour la paix, conforme aux règles du droit international, en vue de garantir les droits des victimes et de contribuer à instaurer une paix stable et durable; considérant que les parties ont convenu de la mise en place d'un système intégral de vérité, de justice, de réparation et de non-répétition comprenant la création d'une commission pour l'établissement de la vérité, la coexistence et la non-répétition, ainsi que des accords sur la réparation en faveur des victimes et la fin de l'impunité; considérant qu'à la suite de cet accord, les deux parties ont convenu d’instaurer la paix, le 23 mars 2016 au plus tard;

They upheld the provisions on the basis of criminal law, and they refused to enter into a discussion of whether there would also be concurrent jurisdiction under peace, order, and good government.

(2) A justice of the peace may, where a building, receptacle or place referred to in subsection (1) is in a territorial division other than that in which the justice of the peace has jurisdiction, issue his warrant in a form similar to the form referred to in subsection (1), modified according to the circumstances, and the warrant may be executed in the other territorial division after it has been endorsed, in the manner set out in Form 28 of Part XXVIII of the Criminal Code, by a justice of the peace having jurisdiction in that territorial division.
(2) Le juge de paix peut, lorsque le lieu visé au paragraphe (1) est situé hors de son ressort, décerner un mandat établi en une forme comparable, compte tenu des adaptations de circonstance, à celle dont il est fait mention à ce paragraphe et exécutable après avoir été visé, suivant la formule 28 de la partie XXVIII du Code criminel, par le juge de paix dans le ressort duquel est situé le lieu objet de la perquisition.

(5) If a justice of the peace before whom a preliminary inquiry is being or is to be held has not commenced to take evidence, any justice of the peace having jurisdiction in Nunavut has jurisdiction for the purpose of subsection (3).

462.32 (1) Subject to subsection (3), if a judge, on application of the Attorney General, is satisfied by information on oath in Form 1 that there are reasonable grounds to believe that there is in any building, receptacle or place, within the province in which the judge has jurisdiction or any other province, any property in respect of which an order of forfeiture may be made under subsection 462.37(1) or (2.01) or 462.38(2), in respect of a designated offence alleged to have been committed within the province in which the judge has jurisdiction, the judge may issue a warrant authorizing a person named in the warrant or a peace officer to search the building, receptacle or place for that property and to seize that property and any other property in respect of which that person or peace officer believes, on reasonable grounds, that an order of forfeiture may be made under that subsection.

I will not get into the detail, but I want to be assured that a Canadian peace officer who is operating in U.S. jurisdiction as part of this framework, or his or her counterpart — that is, an American police officer operating in Canada's jurisdiction under this framework — will have the full range of protections that a peace officer of that country would have in that same jurisdiction, namely, national treatment.
Je ne vais pas entrer dans les détails, mais j'aimerais être assuré que tout agent de la paix canadien en service actif sur le territoire américain en application de l'accord, ou que son homologue américain en service actif sur le territoire canadien dans les mêmes circonstances, aura droit à toute la protection dont disposent les agents de la paix locaux de ce pays, c'est-à- dire droit au traitement national.
