The convention is intended to strengthen Community legislation on the recognition and enforcement of judgments on matters of maintenance obligations, and to strengthen administrative cooperation between Central Authorities by establishing a harmonised set of rules in the Community in relation to third countries which become parties to the convention.

(11) The content of a agreement reached by mediation which is rendered enforceable in a Member State will be recognised and declared enforceable in the other Member States in accordance with applicable Community or national law, for example on the basis of Council Regulation (EC) No 44/2001 of 22 December 2000 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters or Council Regulation (EC) No 2201/2003 of 27 November 2003 concerning jurisdiction and the recognition and enforcement of judgments in matrimonial matters and the matters of parental responsibility.

According to Article 4 of the Agreement of 19 October 2005 between the European Community and the Kingdom of Denmark on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters (hereinafter ‘the Agreement’), concluded by Council Decision 2006/325/EC , whenever implementing measures are adopted pursuant to Article 74(2) of Council Regulation (EC) No 44/2001 of 22 December 2000 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters , Denmark’s decision on whether or not to implement the content of such measures shall be notified to the Commission.

My primary difference of opinion with the rapporteur is that I believe that the possible problem of the supreme courts coming to divergent judgments in matters of basic rights has not been resolved. As a former supreme court judge, I know what I am talking about. Despite this, the institutionalisation of basic rights prevails, and so the vote has been in favour of the report as a whole.

The competent court or authority of a Member State where a judgment was given shall issue, at the request of any interested party, a certificate using the standard form in Annex IV (judgments in matrimonial matters) or Annex V (judgments on parental responsibility).

(7) In order to attain the objective of free movement of judgments in matrimonial matters and in matters of parental responsibility within the Community, it is necessary and appropriate that the cross-border recognition of jurisdiction and judgments in relation to the dissolution of matrimonial ties and to parental responsibility for the children of both spouses be governed by a mandatory, and directly applicable, Community legal instrument.
(7) Pour atteindre l'objectif de la libre circulation des jugements en matière matrimoniale et en matière de responsabilité parentale au sein de la Communauté, il est nécessaire et approprié que la reconnaissance transfrontières des compétences et des jugements en matière de dissolution du lien matrimonial et de responsabilité parentale des enfants communs soit régie par un instrument juridique communautaire contraignant et directement applicable.
