Error of law consisting in finding that there was an extension of the time limit laid down in paragraph 5 of point II. 22 of general conditions FP7 for the presentation of the final versions of audit reports 11-INFS-025 and 11-BA119-016 (paragraphs 93 and 95 of the judgment under appeal) and that the Commission did not breach the grant agreement (paragraph 97 of the judgment under appeal).

Secondly, the Court’s reasons are contradictory, since it first applies the case-law on the selectivity of fiscal measures (paragraphs 51 and 53 of the judgment under appeal) and then finds that it is not relevant (paragraph 57 of the judgment under appeal).

In view of the fact that, as recognised in the judgment under appeal, the decision adopted by the Commission on 8 October 2010 does not contain any express reason for the requirement for the bank issuing the guarantee to have a credit rating, the judgment under appeal was incorrect in so far as it found that the contested measure was not vitiated by an inadequate statement of reasons, as claimed by the appellants in the proceedings before the General Court.
