However, the Finnish parent company, Kone Oyj, was held jointly and severally liable with its German subsidiary Kone GmbH for a fine of €62.37 million and with its Netherlands subsidiary Kone BV for a fine of €79.75 million for the infringements in Germany and the Netherlands respectively.

The companies that received fines under that decision included three companies in the Quinn Group: Quinn Plastics GmbH (successor to Barlo Plastics GmbH, which had participated in the collusive behaviour), Quinn Plastics NV (successor to Barlo Plastics NV, the parent company of Barlo Plastics GmbH) and Quinn Barlo (successor to Barlo Group Ltd., the parent company of the former Barlo group. The Commission found that they had participated in the infringement from 30 April 1998 to 21 August 2000 and imposed on them a fine of €9 million, for which they were jointly and severally liable.

In the part of its decision which relates to the applicant, the Commission adjudged it to be jointly and severally liable with Sachsa Verpackung GmbH for the breach by reason of its status as parent company of Sachsa Verpackung.

By the first plea, which is put forward as the principal plea, the applicant submits that the Commission breached the provisions of Article 81(1) EC by incorrectly attributing to it joint and several liability for the practices engaged in by Sachsa and by holding it jointly and severally liable for payment of the fine imposed on Sachsa.

By its third plea, put forward as a further alternative, the applicant contends that the Commission infringed the principle of proportionality by imposing an allegedly excessive fine on Sachsa and Groupe Gascogne jointly and severally, in particular by failing to ensure that there was a reasonable relation between the penalty imposed and the actual turnover achieved by Groupe Gascogne within the plastic bags sector.
Par son troisième moyen présenté à titre très subsidiaire, la requérante soutient que la Commission aurait violé le principe de proportionnalité en infligeant conjointement et solidairement à Sachsa et au Groupe Gascogne, une amende prétendument excessive notamment en s'abstenant de veiller à l'existence d'un rapport raisonnable entre la sanction infligée et le chiffre d'affaires effectivement réalisé par le Groupe Gascogne dans le secteur des sacs plastiques.
