At the Transport Council meeting held on 26 March 2002, and with regard to the Regulation setting up the Joint Undertaking, as finally adopted on 21 May 2002, the Council and the Commission, on the one hand, and Belgium, on the other, made a declaration of commitment to exempt the Joint Undertaking and its staff from all taxes and social charges or similar obligations, to the extent that this was compatible with Community law and national law.

On receipt of the Court of Auditors' observations on the ECSEL Joint Undertaking's provisional accounts pursuant to Article 148 of Regulation (EU, Euratom) No 966/2012, the accounting officer shall draw up the ECSEL Joint Undertaking's final accounts and the Executive Director shall submit them to the Governing Board for an opinion.

4. Observes from the Joint Undertaking's final annual accounts that while the utilisation rate for commitment appropriations was 84 % overall, the rate for payment appropriations was 75 %; notes, moreover, that within this, the operational implementation rate was 97 % for commitment appropriations and 84 % for payment appropriations; remains concerned, despite improvements over 2011, that these rates reflect the significant delays in the implementation of the activities as compared with the initial plan; requests that the Joint Undertaking continue to improve its workflows and processes to shorten the period between the publication of calls for proposals and the signing of grant agreements;

Takes note that the Joint Undertaking's final budget for the financial year 2011 included commitment appropriations of EUR 148 000 000 and payment appropriations of EUR 91 700 000; further acknowledges that the utilisation rates for commitment and payment appropriations were 99,4 % and 82,4 % respectively;

All decisions adopted and contracts concluded by the Joint Undertaking, shall provide explicitly that OLAF and the Court of Auditors may carry out on-the-spot inspections of the documents of all contractors and sub-contractors which have received Community funds, including inspections at the premises of the final beneficiaries’.
