When Member States submit joint recommendations in accordance with Article 19 to amend the closed or restricted areas listed in Part C of Annexes V to VIII and X and Part B of Annex XI or establish new closed or restricted areas they shall include the following elements in respect of such closed or restricted areas in those joint recommendations:

Based on the scientific evidences provided in the joint recommendation, the revision by the STECF and taking into account the characteristics of the gears, the high number of species in each fishing operations, the fishing patterns and the particularities of the Mediterranean Sea (e.g. predominance of small-scale fisheries), the Commission considers that, in order to avoid disproportionate costs of handling unwanted catches and in accordance with Article 15(5)(c)(ii) of Regulation (EU) No 1380/2013, it is appropriate to establish a de minimis exemption in accordance with the percentage level proposed in the joint recommendations, within the limits set out in Article 15(5)(c) of Regulation (EU) No 1380/2013.

S. whereas the adoption of technical measures on a regional basis should follow the model agreed by the co-legislators under the new CFP, namely for the Commission to adopt delegated acts on the basis of joint recommendations from the Member States concerned that meet the standards and objectives decided by the co-legislators, or, if the Member States concerned do not submit a joint recommendation within the designated time, on the Commission’s own initiative; whereas, however, Parliament retains the right to object to any delegated acts under the Lisbon Treaty;

2b. Any deviations by the Commission from the joint recommendations shall be presented to the European Parliament and to the Council and shall be capable of being scrutinised.
