76. Stresses that tax competition is far from being limited to the Member States, including their dependent or associated territories, and that most practices under consideration have an international dimension, through the shifting of profits to low- or no-tax or secrecy jurisdictions where, often, no substantial economic activity takes place; deplores the lack of a coordinated approach on the part of the Member States vis-à-vis all those jurisdictions, not only in terms of joint action or reaction against their harmful practices, but also, despite the Commission’s efforts, regarding their identification and the relevant criteria; strongly supports, therefore, the Commission’s 2012 proposal, which includes substantial criteria for ensuring fair competition in addition to transparency and the exchange of information, as well as the recent publication, in the Commission’s tax package of 17 June 2015, of a list of non-cooperative tax jurisdictions, established following a ‘common denominator’ approach on the basis of lists existing at national level; stresses that the establishment of such a list is a prerequisite for taking appropriate action against such jurisdictions; believes that this list should be the first iteration of a process that results in a rigorous, objective definition of ‘tax havens’ which can then inform future lists, established on the basis of clear criteria that should be known in advance; encourages the Commission to assess whether European jurisdictions comply with these criteria;
76. souligne que la concurrence en matière fiscale, loin d'avoir pour acteurs les seuls États membres (territoires dépendants ou associés compris), recouvre un ensemble de pratiques d'envergure internationale, qui s'appuient sur le transfert de bénéfices vers des juridictions sans réelle activité économique, qui cultivent une fiscalité réduite ou inexistante, ou le secret; déplore l'absence de toute démarche d'ensemble des États membres face à ces juridictions, non seulement en termes d'action ou de réaction communes face à leurs pratiques dommageables, mais encore, et ce malgré tous les efforts de la Commission en ce sens, en termes d'établissement d'une liste et de définition de critères pertinents régissant cette dernière; accorde, dès lors, tout son soutien à la proposition présentée par la Commission en 2012, qui comprend des critères concrets pour assurer une concurrence équitable, la transparence et l'échange des informations, ainsi qu'à la publication récente, dans le train de mesures sur la fiscalité de la Commission du 17 juin 2015, d'une liste de juridictions fiscales non coopératives, établie sur la base d'une démarche fondée sur un dénominateur commun issu de listes existant au niveau national; souligne que l'établissement d'une telle liste est indispensable avant de prendre quelque mesure que ce soit à l'encontre de ces juridictions; est convaincu que cette liste devrait être la première mouture d'un processus aboutissant à une définition rigoureuse et objective des "paradis fiscaux", qui pourra ensuite servir de base à d'autres listes, établies sur la base de critères clairs, qui devraient être connus à l'avance; encourage la Commission à vérifier que les juridictions européennes respectent ces critères;

Article 6(1) of Council Regulation (EC) No 44/2001 of 22 December 2000 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters must be interpreted as meaning that the rule on centralisation of jurisdiction in the case of several defendants, as established in that provision, can apply in the case of an action for damages, and for disclosure in that regard, brought jointly against undertakings which have participated in different places and at different times in a single and continuous infringement, which has been established by a decision of the European Commission, of the prohibition of anti-competitive agreements, decisions and concerted practices provided for under EU law, even where the applicant has withdrawn its action against the sole co-defendant domiciled in the same State as the court seised, unless it is found that, at the time the proceedings were instituted, the applicant and that defendant had colluded to artificially fulfil, or prolong the fulfilment of, that provision’s applicability;
L’article 6, point 1, du règlement (CE) no 44/2001 du Conseil, du 22 décembre 2000, concernant la compétence judiciaire, la reconnaissance et l’exécution de décisions en matière civile et commerciale, doit être interprété en ce sens que la règle de concentration des compétences en cas de pluralité de défendeurs que cette disposition établit peut s’appliquer à l’égard d’une action visant à la condamnation à titre solidaire à des dommages et intérêts et, dans le cadre de celle-ci, à la production de renseignements, d’entreprises qui ont participé de façon différente, sur les plans géographique et temporel, à une infraction unique et continue à l’interdiction des ententes prévue par le droit de l’Union constatée par une décision de la Commission européenne, et cela même lorsque le demandeur s’est désisté de son action à l’égard du seul des codéfendeurs qui est domicilié dans l’État membre du siège de la juridiction saisie, à moins que ne soit établie l’existence d’une collusion entre le demandeur et ledit codéfendeur en vue de créer ou de maintenir, de manière artificielle, les conditions d’application de ladite disposition à la date de l’introduction de cette action.

As regards the resolution of disputes in contractual matters, any grant agreements or contracts concluded by the Clean Sky Joint Undertaking could provide for the jurisdiction of the Court of Justice.
