- EXPORTS OF HAZARDOUS WASTE - COUNCIL CONCLUSIONS "Referring to the results of the first meeting of the Contracting Parties to the Basle Convention in Uruguay and in particular Decisions I/16 and I/22 concerning the introduction of a total ban on shipments of hazardous waste to developing countries at the second meeting of the Parties; Referring also to the statement made by the Presidency on behalf of the European Community at the same meeting on 4 December 1992; Recalling that Council Regulation (EEC) No 259/93 of 1 February 1993 already provides for a ban on all exports of waste for disposal to all countries except EFTA countries and establishes strict measures for all exports of hazardous waste for recovery to countries to which the OECD decision does not apply; Recalling that Article 39 of the Lomé Convention provides for a total ban on exports of waste to ACP States, THE COUNCIL DECIDES that the Community should support and actively work for the implementation and further development of the Basle Convention; NOTES that Article 17(1) of the Convention states that: "Any Party may propose amendments to this Convention ..". and that in accordance with Article 17(2) of the Convention any amendment to the Basle Convention must be forwarded to the Contracting Parties by the Interim Secretariat of the Convention not later than six months prior to the second meeting of the Contracting Parties, which is expected to take place in February/March 1994, and accordingly INVITES the Commission to examine any circumstances justifying the call for a total ban on exports of hazardous waste covered by the Basle Convention to developing countries and to submit appropriate proposals to it at the earliest possible date.
- EXPORTATION DE DECHETS DANGEREUX - CONCLUSIONS DU CONSEIL "Se référant aux résultats de la première réunion des parties à la Convention de Bâle, qui s'est tenue en Uruguay, et notamment aux décisions 1/16 et 1/22 relatives à l'instauration, lors de la deuxième réunion des parties, d'une interdiction totale des transferts de déchets dangereux vers les pays en développement; Se référant également à la déclaration faite par la Présidence au nom de la Communauté européenne lors de cette même réunion, le 4 décembre 1992; Rappelant que le règlement (CEE) n° 259/93 du Conseil, du 1er février 1993, dispose d'ores et déjà que toute exportation de déchets destinés à être éliminés est interdite à destination de quelque pays que ce soit, à l'exception des pays membres de l'AELE ; qu'il prévoit par ailleurs des mesures rigoureuses pour toutes les exportations de déchets dangereux valorisables à destination des pays auxquels la décision de l'OCDE ne s'applique pas; Rappelant qu'aux termes de l'article 39 de la Convention de Lomé, l'exportation de déchets à destination des pays ACP est totalement interdite, LE CONSEIL DECIDE que la Communauté doit soutenir la mise en oeuvre et le développement de la Convention de Bâle et oeuvrer activement dans ce sens ; CONSTATE que l'article 17 paragraphe 1 de la Convention dispose que "toute partie peut proposer des amendements à la présente Convention ..". et que en vertu de l'article 17 paragraphe 2 de la Convention, tout amendement à celle-ci doit être communiqué par le Secrétariat intérimaire de la Convention aux parties contractantes, six mois au moins avant la deuxième réunion des parties contractantes, dont la tenue est prévue pour février/mars 1994 ; en conséquence INVITE la Commission à examiner toutes circonstances qui justifient l'appel en faveur de l'interdiction totale des exportations de déchets dangereux couverts par la Convention de Bâle vers les pays en voie de développement et à lui soumettre des propositions approprié ...
